Temel \u0130lkeler b\u00f6l\u00fcm\u00fcn\u00fcn 5. maddesinde de belirtildi\u011fi gibi T\u00fcrkiye Cumhuriyeti Devleti&#8217;nin en \u00f6nemli iki sermayesinden biri olan insan kayna\u011f\u0131n\u0131 do\u011frudan ilgilendiren piyasad\u0131r. Devletin hedefi bu kayna\u011f\u0131 y\u0131pratmadan en verimli \u015fekilde kullan\u0131lmas\u0131n\u0131 sa\u011flamak ve de\u011ferini art\u0131rmakt\u0131r <a href=\"http:\/\/misak.millidusunce.com\/turk-ekonomisi-hakkinda-dusunce-ve-oneriler-2\/\">(Milli E\u011fitimle ilgili k\u0131sma bak\u0131n\u0131z)<\/a>.<\/p>\n<p>Resmi verilere g\u00f6re May\u0131s 2017\u2019de i\u015fsizlik oran\u0131 %10,17 olarak tespit edilmi\u015ftir. Yani T\u00fcrkiye Cumhuriyeti Devletinin \u00e7al\u0131\u015fabilecek durumda ve sorumlulukta olan vatanda\u015flar\u0131n\u0131n %10,17\u2019si \u00e7al\u0131\u015fm\u0131yor. Alt\u0131n\u0131 \u00e7izmek i\u00e7in tekrar tekrar vurgulanmas\u0131 gerekir: %10,17 resm\u00ee orand\u0131r.<\/p>\n<p>Ger\u00e7ekte bu oran\u0131n \u00e7ok daha y\u00fcksek oldu\u011fu tahmin edilmektedir. \u0130statistiksel verilerde yer alan i\u015f arayanlara, e\u011fitim hayat\u0131nda olmamalar\u0131na ra\u011fmen \u00e7al\u0131\u015fabilir \u00e7a\u011fda olup i\u015f aramayanlar\u0131n rakam\u0131n\u0131 da g\u00f6z \u00f6n\u00fcnde bulundurdu\u011fumuzda i\u015fsizlik oran\u0131n\u0131n %20 civar\u0131 oldu\u011fu g\u00f6r\u00fclmekte. Bu \u00e7al\u0131\u015fabilir \u00e7a\u011fda olanlar\u0131n say\u0131s\u0131n\u0131 kaba taslak 30 milyon civar\u0131 var sayd\u0131\u011f\u0131m\u0131zda 6 milyon insana tekab\u00fcl eder. Yani \u00fcretmeyen veya \u00fcretemeyen 6 milyon insan\u0131n y\u00fck\u00fc geri kalan 24 milyon \u00e7al\u0131\u015fan insan taraf\u0131ndan ta\u015f\u0131nmakta. Bu kabul edilebilecek adil bir durum de\u011fildir. Lakin burada \u00f6nemli olan husus, 6 milyon i\u015fsizi su\u00e7lamaktansa bu insanlara i\u015f hayat\u0131na kat\u0131l\u0131m imkan\u0131n\u0131n ne kadar sunuldu\u011funu ara\u015ft\u0131rmakt\u0131r. Ayr\u0131ca ekonomide bu kapasitenin kullan\u0131lmamas\u0131n\u0131n sebepleri de incelenmelidir. Zira 6 milyon insan\u0131n \u00e7al\u0131\u015fmamas\u0131n\u0131n, \u00fcretmemesinin yegane sebebi tembellik olamaz. Dolay\u0131s\u0131yla ancak ekonomik imkanlar\u0131n verimsiz da\u011f\u0131t\u0131m\u0131 s\u00f6z konusudur.<\/p>\n<p>En verimli \u00e7al\u0131\u015fan ekonomilerde bile %2\u2019ye kadar bir i\u015fsizlik oran\u0131 tabii\u00a0i\u015fsizlik olarak kabul edilir. Bu %2 emeklili\u011fine az kala i\u015fsiz kalm\u0131\u015f, veya i\u015fini kaybetmi\u015f ve ba\u015fka i\u015f bulana kadar i\u015f arad\u0131\u011f\u0131n\u0131 belirtmi\u015f insanlardan olu\u015fan orand\u0131r. Dolay\u0131s\u0131yla devletin i\u015f piyasas\u0131na y\u00f6nelik ilk hedefi i\u015fsizli\u011fin %2\u2019yi ge\u00e7memesi olmal\u0131d\u0131r. Bu hedefi ger\u00e7ekle\u015ftirirken dikkat etmesi gereken husus ise i\u015f imkan\u0131 sunanlar ile i\u015f arayanlar\u0131n ihtiya\u00e7lar\u0131n\u0131n bulu\u015ftu\u011fu arz ve talebin hassas dengesidir. Zira bir yandan \u00e7al\u0131\u015fanlar\u0131n i\u015f g\u00fcvenli\u011fi -\u0130\u015f g\u00fcvenli\u011fi iki temel s\u00fctundan olu\u015fur. Birincisi i\u015f yerinin g\u00fcvenli\u011fidir, ikincisi i\u015f yerinde g\u00fcvenliktir; sa\u011flanmas\u0131 gerekir, di\u011fer yandan da i\u015f verenlerin hala en \u00f6nemli \u00fcretim ve\u00a0dolay\u0131s\u0131yla maliyet unsurlar\u0131ndan biri olan i\u015f g\u00fcc\u00fcn\u00fc \u00fcretimde esnek kullanabilmeleri sa\u011flanmal\u0131d\u0131r.<\/p>\n<p>Devletin i\u015f g\u00fcvenli\u011fi konusunda \u00e7al\u0131\u015fanlar\u0131n haklar\u0131n\u0131 koruyan uygulamalar\u0131 i\u015f verenin esnekli\u011finin azalmas\u0131na yol a\u00e7acakt\u0131r. Ayn\u0131 \u015fekilde i\u015f verenin esnekli\u011finin temin etmek isteyen uygulamalarsa bir \u015fekilde \u00e7al\u0131\u015fan\u0131n haklar\u0131n\u0131n korunamamas\u0131na yol a\u00e7abilir. \u0130\u015fte bu sebepten \u00f6t\u00fcr\u00fc devlet \u00f6zellikle i\u015f piyasas\u0131nda \u00e7ok hassas davranmal\u0131 ve Temel \u0130lkeler b\u00f6l\u00fcm\u00fcn\u00fcn 7. do\u011frultusunda m\u00fcmk\u00fcn oldu\u011fu kadar i\u015f piyasas\u0131na kar\u0131\u015fmadan i\u015f veren ve \u00e7al\u0131\u015fanlar\u0131n sorumluluk ve haklar\u0131n\u0131 kendilerinin belirlemelerini ve uygulamalar\u0131n\u0131 sa\u011flamal\u0131d\u0131r.<\/p>\n<h2><strong>\u00c7al\u0131\u015fma ve i\u015f kurma hakk\u0131<\/strong><\/h2>\n<p>\u00c7al\u0131\u015fma ve i\u015f hayat\u0131na kat\u0131lma hakk\u0131 sadece T\u00fcrkiye Cumhuriyeti Devleti vatanda\u015flar\u0131n\u0131n veya \u00e7al\u0131\u015fma veya i\u015f yeri a\u00e7ma hakk\u0131 kazanan yabanc\u0131lar\u0131n olmal\u0131d\u0131r. Bu hakk\u0131 sonradan kazanmak i\u00e7in lise seviyesinde dil ve sosyal bilgiler derecesi al\u0131nmas\u0131 gerekli olmal\u0131d\u0131r. T\u00fcrk vatanda\u015f\u0131 olmadan ve bu hakka sahip olmadan i\u015f hayat\u0131na kat\u0131lan herkes ka\u00e7ak olarak g\u00f6r\u00fclmeli, cezaland\u0131r\u0131lmal\u0131, ve ka\u00e7ak i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131ran i\u015f yerleri a\u011f\u0131r cezalara \u00e7arpt\u0131r\u0131lmal\u0131d\u0131r.<\/p>\n<p>14 ya\u015f\u0131n\u0131 bitirmeden i\u015f hayat\u0131na kat\u0131lmak kesinlikle yasaklanmal\u0131d\u0131r. 14 ya\u015f\u0131ndan itibaren \u00e7ocuklar bedensel ve ruhsal geli\u015fimlerine olumsuz etki yapmayacak i\u015flerde yard\u0131mc\u0131 i\u015f\u00e7i olarak okulun yan\u0131 s\u0131ra g\u00fcnde 2 saati, ama toplam haftada 8 saati ge\u00e7memek \u015fart\u0131yla velilerinin yaz\u0131l\u0131 m\u00fcsaadesi de kayda al\u0131narak \u00e7al\u0131\u015fabilirler. Ayr\u0131ca i\u015f veren \u00e7ocu\u011fun ders saatlerinde \u00e7al\u0131\u015fmad\u0131\u011f\u0131n\u0131 kan\u0131tlamakla m\u00fckelleftir. \u00c7al\u0131\u015fma saatlerindeki s\u0131n\u0131rlama hari\u00e7, yard\u0131mc\u0131 i\u015f\u00e7iler i\u00e7in ge\u00e7erli olan hak ve sorumluluklar bu kapsamda da ge\u00e7erlidir. Dolay\u0131s\u0131yla yard\u0131mc\u0131 i\u015f\u00e7i olarak \u00e7al\u0131\u015fan \u00e7ocuklar\u0131n da saat \u00fccreti yard\u0131mc\u0131 i\u015f\u00e7ilerin ald\u0131\u011f\u0131 \u00fccretten d\u00fc\u015f\u00fcn olamaz.<\/p>\n<p>\u00c7ocuklar\u0131n yard\u0131mc\u0131 i\u015f\u00e7i olarak \u00e7al\u0131\u015fmas\u0131, onlar\u0131 ucuz i\u015f g\u00fcc\u00fc olarak suistimal etmek de\u011fil, makul bir ya\u015fta i\u015f hayat\u0131 ile tan\u0131\u015farak tecr\u00fcbe edinmeleri ve ki\u015filiklerinin olumlu bir \u015fekilde geli\u015fmesini hedeflemektir. Bu hedef d\u0131\u015f\u0131nda \u00e7ocuklar\u0131 \u00e7al\u0131\u015ft\u0131ranlar takip edilmeli ve cezaland\u0131r\u0131lmal\u0131d\u0131r.<\/p>\n<h2><strong>Asgari \u00fccret ve ekonomide i\u015f \u00fccretinin olu\u015fumu<\/strong><\/h2>\n<p>Evvela \u2018asgari \u00fccret\u2019 uygulamas\u0131ndan acilen vazge\u00e7ilmelidir. Asgari \u00fccret devletin i\u015f piyasas\u0131na yapabilece\u011fi m\u00fcdahalelerin en a\u011f\u0131rlar\u0131ndan biridir, hatta belki de en a\u011f\u0131r\u0131d\u0131r ve piyasan\u0131n kendi olu\u015fturmas\u0131 gereken tabii dengeyi bozar.<\/p>\n<p>Devlet asgari \u00fccret belirlemektense \u00e7al\u0131\u015fanlar\u0131n sa\u011fl\u0131kl\u0131 bir sosyal g\u00fcvenlik i\u00e7inde olmas\u0131n\u0131 sa\u011flamal\u0131d\u0131r. Bu en az 12 ay olmak suretiyle \u00e7al\u0131\u015fanlar\u0131n prim \u00f6dedi\u011fi s\u00fcre\u00e7le orant\u0131l\u0131 bir i\u015fsizlik sigortas\u0131 \u015feklinde olmal\u0131d\u0131r. Bu sigortan\u0131n hedefi i\u015fsiz kal\u0131nd\u0131\u011f\u0131 s\u00fcrecin ba\u015f\u0131nda insanlar\u0131n hayatlar\u0131na kimseye muhta\u00e7 olmadan devam edebilmelerini sa\u011flamak ve akabinde yeni i\u015f aramalar\u0131n\u0131 te\u015fvik etmek olmal\u0131d\u0131r. Bunun i\u00e7in 12 aydan fazla i\u015fsiz kalan insanlar yeni i\u015f bulmakta gerekli olan esnekli\u011fi g\u00f6stermediklerinde i\u015fsizlik paras\u0131n\u0131n azalt\u0131lmas\u0131 d\u00fc\u015f\u00fcn\u00fclebilir. \u0130\u015fsiz kalan kimsenin makul ve e\u011fitimine uygun teklif edilen d\u00fcr\u00fcst bir i\u015fi be\u011fenmeme ve dolay\u0131s\u0131yla toplumun s\u0131rt\u0131ndan ge\u00e7inme gibi bir l\u00fcks\u00fc olmamal\u0131d\u0131r. \u0130\u015fsiz olup tekrar i\u015f hayat\u0131na geri d\u00f6nmekte ger\u00e7ekten makul sebeplerden \u00f6t\u00fcr\u00fc zorlananlar i\u00e7in uygulanmas\u0131 gereken ba\u015fka sosyal g\u00fcvence sistemleri var olmal\u0131d\u0131r.<\/p>\n<p>Genel olarak devlet sekt\u00f6rler aras\u0131 ge\u00e7i\u015f engellerini d\u00fc\u015f\u00fcrmeli, i\u015f verenlerle beraber i\u015f verenlerin kendi sekt\u00f6rleri i\u00e7in e\u011fitim imkanlar\u0131n\u0131 art\u0131rmalar\u0131n\u0131 sa\u011flamal\u0131d\u0131r. \u00d6rne\u011fin s\u0131k\u0131nt\u0131 \u00e7eken bir sekt\u00f6rde \u00e7al\u0131\u015fan bir eleman belli bir e\u011fitimi ald\u0131ktan sonra i\u015f g\u00fcc\u00fc arayan ba\u015fka bir sekt\u00f6re uyum sa\u011flayarak i\u015fini de\u011fi\u015ftirme imkan\u0131na sahip olmal\u0131d\u0131r.<\/p>\n<h2><strong>\u0130\u015f veren ve i\u015f alanlar\u0131n sorumluluklar\u0131 ve sendikalar\u0131n rol\u00fc<\/strong><\/h2>\n<p>\u0130\u015f veren ve \u00e7al\u0131\u015fanlar\u0131n bulunduklar\u0131 sekt\u00f6rde kendi aralar\u0131nda te\u015fkilatlanarak bir masaya oturmalar\u0131n\u0131 ve hak ve sorumluluklar\u0131n\u0131 kendi aralar\u0131nda kararla\u015ft\u0131rmalar\u0131 sa\u011flanmal\u0131d\u0131r. Dolay\u0131s\u0131yla i\u015f verenlerin sanayi ve ticaret odalar\u0131 kapsam\u0131nda ve \u00e7al\u0131\u015fanlar\u0131n da sendikalar \u00e7at\u0131s\u0131nda te\u015fkilatlanmalar\u0131 gerekmektedir. Sekt\u00f6r ve meslek grubu dikkate al\u0131narak sendika say\u0131s\u0131n\u0131n gerekli olmad\u0131\u011f\u0131nda biri a\u015fmamas\u0131na dikkat edilmelidir. Devletin yapaca\u011f\u0131 bu sendika ve odalar\u0131n yap\u0131lanmalar\u0131na ve verimli i\u015flemelerine dair gerekli mevzuat\u0131 sa\u011flamakt\u0131r.<\/p>\n<p>Sendikalar\u0131n ve i\u015f veren kurulu\u015flar\u0131n kararla\u015ft\u0131rd\u0131klar\u0131 mevzuat kesinlikle ki\u015filik haklar\u0131n\u0131 ihlal edici unsurlar bar\u0131nd\u0131ramaz. Kanunlar\u0131n garantiledi\u011fi genel ki\u015fisel hak ve sorumluluklar uyulmas\u0131 gereken asgari zemindir.<\/p>\n<p>\u0130\u015f verenlerin \u00f6nemsemesi gereken husus, \u00f6ncelikli hedeflerinin kar oranlar\u0131n\u0131 art\u0131rmak de\u011fil, \u00e7al\u0131\u015fanlar\u0131na ve topluma kar\u015f\u0131 ta\u015f\u0131d\u0131klar\u0131 sorumluluklar\u0131d\u0131r. \u0130\u015f verenlerin hak ve sorumluluklar\u0131na y\u00f6nelik kanunlar, i\u015f verenlere tan\u0131nan t\u00fcm hak ve esnekli\u011fin bu do\u011frultuda \u015fekillenece\u011fi \u00fczere yap\u0131labilir.<\/p>\n<p>Sendikalar\u0131n yegane vazifesi ise, mensup \u00fcyelerinin hak ve g\u00fcvencelerini art\u0131rmak olmal\u0131d\u0131r. Sendikalar siyasi g\u00f6r\u00fc\u015f veya parti mensubiyeti do\u011frultusunda de\u011fil, temsil ettikleri meslek grubunun ihtiya\u00e7 ve istekleri do\u011frultusunda yap\u0131lanmal\u0131, te\u015fkilatlanmalar\u0131nda sadece kendi \u00fcyeleri s\u00f6z sahibi olmal\u0131d\u0131r. Temsil etti\u011fi sendikay\u0131 kendi mesleki konular\u0131 hari\u00e7 ba\u015fka konular do\u011frultusunda y\u00f6neten sendika yetkilileri cezaland\u0131r\u0131lmal\u0131d\u0131r. Ayn\u0131 zamanda sendika y\u00f6netici ve s\u00f6zc\u00fclerinin g\u00f6rev s\u00fcreleri ba\u015flamadan, g\u00f6rev s\u00fcreleri boyunca ve g\u00f6revleri bittikten 3 sene sonraya kadar siyasi parti mensubu olmalar\u0131 ve siyasi partiler ve siyasi partilere yak\u0131n kurumlar\u0131n faaliyetlerinde bulunmamalar\u0131 \u015fart\u0131 olmal\u0131d\u0131r.<\/p>\n<p>Her \u00e7al\u0131\u015fan\u0131n sendika \u00fcyesi olma hakk\u0131 devlet taraf\u0131ndan g\u00fcvenceye al\u0131nmal\u0131d\u0131r. Lakin her \u00e7al\u0131\u015fan\u0131n sendika \u00fcyesi olma zorunlulu\u011fu bulunmamal\u0131d\u0131r. Bir \u00e7al\u0131\u015fan\u0131n sendika \u00fcyesi olmas\u0131 veya olmamas\u0131ndan dolay\u0131 herhangi bir ayr\u0131mc\u0131l\u0131\u011fa maruz kalmas\u0131 asla kabullenemez.<\/p>\n<p>Sendikalar\u0131n yetkileri, temsil ettikleri meslek grubu i\u00e7in maa\u015f, \u00e7al\u0131\u015fma \u015fartlar\u0131, i\u015f g\u00fcvenli\u011fi gibi konularda ba\u015fta \u00fcyeleri olmak \u00fczere sorumlu olduklar\u0131 t\u00fcm meslek grubunun hak ve taleplerini temsil etmek, \u00fcyelerine hukuki destek sa\u011flamak ve gerekti\u011finde grev \u00e7a\u011fr\u0131s\u0131 yapmay\u0131 kapsamal\u0131d\u0131r. Ayr\u0131ca sendikalar\u0131n grev esnas\u0131nda para kazanamayan \u00fcyelerine belli bir yevmiye vermek i\u00e7in \u00fcyeleri taraf\u0131ndan \u00f6denen aidatlardan faydalanarak bir fon olu\u015fturmalar\u0131 da m\u00fcmk\u00fcn olmal\u0131d\u0131r.<\/p>\n<p>Grev \u00e7a\u011fr\u0131s\u0131na kat\u0131lmak veya kat\u0131lmamak o meslek grubunun mensuplar\u0131n\u0131n her birinin h\u00fcr iradesinde olmal\u0131d\u0131r. Dolay\u0131s\u0131yla ne bir sendika \u00fcyesinin greve kat\u0131lma mecburi k\u0131l\u0131n\u0131r, ne de greve sadece sendika \u00fcyelerinin kat\u0131lmas\u0131. Hi\u00e7 kimse greve kat\u0131ld\u0131\u011f\u0131 i\u00e7in i\u015f yerinde olumsuz davran\u0131\u015flara veya i\u015f yerini kaybetme tehlikesi ile kar\u015f\u0131la\u015fmamal\u0131d\u0131r. Sendika d\u0131\u015f\u0131 bireyler s\u00f6z konusu greve kat\u0131lma haklar\u0131na sahiptirler, lakin sendika mensubiyetinin verdi\u011fi g\u00fcvencelerden faydalanma haklar\u0131 yoktur.<\/p>\n<p>\u0130\u015f piyasas\u0131nda vadesiz s\u00f6zle\u015fme al\u0131\u015f\u0131la gelmi\u015f standart haline getirilmelidir. Bunun yan\u0131 s\u0131ra i\u015f verenlerin vadeli s\u00f6zle\u015fmelerle eleman \u00e7al\u0131\u015ft\u0131rma haklar\u0131 vard\u0131r. Bu vade iki seneyle s\u0131n\u0131rland\u0131r\u0131l\u0131r, ve vade sonu gerekti\u011finde bir kereli\u011fine dair yeni bir iki sene daha uzat\u0131labilir. Ayr\u0131ca orta \u00f6l\u00e7ekli ve b\u00fcy\u00fck kurumlar sunulan i\u015f imkanlar\u0131n\u0131 engelli vatanda\u015flar\u0131m\u0131z\u0131n da s\u0131k\u0131nt\u0131s\u0131z bir i\u015f hayat\u0131 s\u00fcrd\u00fcrebilecekleri \u015fekilde yap\u0131land\u0131rmalar\u0131 ve kurumun b\u00fcy\u00fckl\u00fc\u011f\u00fcne g\u00f6re belli bir say\u0131da engelli vatanda\u015f\u0131m\u0131z\u0131 \u00e7al\u0131\u015ft\u0131rmalar\u0131 zorunlu olmal\u0131d\u0131r. Bu vatanda\u015flar\u0131m\u0131z\u0131n sosyal g\u00fcvenlik ve sigorta primlerinde i\u015f verenlerin y\u00fck\u00fc azalt\u0131lmal\u0131, hatta yine kurumun b\u00fcy\u00fckl\u00fc\u011f\u00fc do\u011frultusunda tamamen devlet taraf\u0131ndan kar\u015f\u0131lanmal\u0131d\u0131r. \u00d6zellikle k\u00fc\u00e7\u00fck kurumlar olmak \u00fczere i\u015f verenlerin \u00f6zel e\u011fitim ve uzmanl\u0131k gerektirmeyen alanlarda haftada 19,5 saate kadar yard\u0131mc\u0131 eleman \u00e7al\u0131\u015ft\u0131rma haklar\u0131 vard\u0131r. Lakin uzmanl\u0131k alan\u0131 gerektiren ve yapt\u0131klar\u0131 i\u015fin\u00a0tabiat\u0131 gere\u011fi asl\u0131nda \u00e7al\u0131\u015ft\u0131rmalar\u0131 gereken anla\u015fmal\u0131 personeli bir veya birden fazla yard\u0131mc\u0131 eleman telafi etmeleri kesinlikle yasaklanmal\u0131d\u0131r.<\/p>\n<p>Yard\u0131mc\u0131 eleman saat \u00fccreti kar\u015f\u0131l\u0131\u011f\u0131 \u00e7al\u0131\u015f\u0131r. Yapmas\u0131 gereken i\u015f ve saat \u00fccretini belirleyen k\u00fc\u00e7\u00fck bir s\u00f6zle\u015fme haricinde ba\u015fka bir anla\u015fmaya gerek yoktur. Yard\u0131mc\u0131 eleman\u0131n saat \u00fccreti yapt\u0131\u011f\u0131 i\u015fte anla\u015fmal\u0131 personellerin ald\u0131\u011f\u0131 ortalama net saat \u00fccretinin alt\u0131nda olamaz. Ayr\u0131ca bu kapsamda \u00e7al\u0131\u015fanlar meslek te\u015fkilatlar\u0131na bildirilmelidir. \u0130\u015f verenin bu kapsamda \u00e7al\u0131\u015fan elemanlar\u0131 i\u00e7in sosyal sigorta veya gelir vergisini yat\u0131rma sorumlulu\u011fu bulunmamal\u0131d\u0131r. Bu sorumluluk bu kapsamda \u00e7al\u0131\u015fan herkesin kendisine aittir.<\/p>\n<p>Sigortas\u0131z personel \u00e7al\u0131\u015ft\u0131rmak kurumun b\u00fcy\u00fckl\u00fc\u011f\u00fcne g\u00f6re a\u011f\u0131r cezalara \u00e7arpt\u0131r\u0131lmal\u0131d\u0131r. \u00c7al\u0131\u015fan\u0131n\u0131n gelir vergisi ve sosyal sigortalar\u0131n\u0131n devlete havale edilmesinden i\u015f veren sorumludur. Sosyal sigorta paylar\u0131n\u0131n %50\u2019si i\u015fveren %50\u2019si ise i\u015f alan taraf\u0131ndan kar\u015f\u0131lan\u0131r. \u00c7al\u0131\u015fan personelin \u00fccreti elden veya \u00e7ek usul\u00fc \u00f6denmesi yasaklanmal\u0131, gelir vergisi ve sosyal sigorta primleri gereken kurumlara havale edildikten sonra \u00fccretin geri kalan \u2018net\u2019 pay\u0131 \u00e7al\u0131\u015fan\u0131n banka hesab\u0131na havale edilmelidir.<\/p>\n<p>Orta \u00f6l\u00e7ekli ve b\u00fcy\u00fck kurumlarda \u00e7al\u0131\u015fanlar, \u00e7al\u0131\u015ft\u0131klar\u0131 kurumun kar pay\u0131na ortak olmal\u0131d\u0131r. Bu hak 12 aydan sonra ba\u015flar ve ilk 12 ay i\u00e7in ge\u00e7erli olmayabilir. Bu paydan haklar\u0131na d\u00fc\u015fen her sene ne i\u015f verenin, ne de \u00e7al\u0131\u015fan\u0131n dokunamayaca\u011f\u0131 hesaplarda muhafaza edilmeli, 5 senede bir veya i\u015f ili\u015fkisinin sonlanmas\u0131 ile \u00e7al\u0131\u015fana \u00f6denmelidir. Y\u00f6neticiler ve personelin ayl\u0131k \u00fccretlerinde fark 6 kat\u0131n\u0131 ge\u00e7memeli, bunun haricinde y\u00f6neticilerin ta\u015f\u0131d\u0131klar\u0131 riskin, sorumlulu\u011fun ve ba\u015far\u0131lar\u0131n\u0131n bedeli kurumun kar pay\u0131na olan ortakl\u0131klar\u0131 \u00fczerinden \u00f6denmelidir. Dolay\u0131s\u0131yla zarar yapan bir kurumda zarar y\u0131l\u0131 i\u00e7in personel kar pay\u0131 alamazsa y\u00f6netici de alamayacakt\u0131r.<\/p>\n<p>\u0130\u015f verenler \u00e7al\u0131\u015fanlar\u0131n\u0131n ki\u015filik haklar\u0131n\u0131n korunmas\u0131ndan sorumludur. Bu kapsamda i\u015f yerinde g\u00fcvenli\u011fi sa\u011flamakla m\u00fckelleftirler. \u0130\u015f kazas\u0131 y\u00fcz\u00fcnden \u00f6lmek veya icra edilen meslek y\u00fcz\u00fcnden hastalanmak veya sakatlanmak hi\u00e7 bir mesle\u011fin kaderi olamaz. \u0130nsanlar\u0131n sa\u011fl\u0131kl\u0131 ve g\u00fcvenceli bir ortamda \u00e7al\u0131\u015fmalar\u0131 en temel insan haklar\u0131ndan biridir ve korunmal\u0131d\u0131r. Bunun i\u00e7in i\u015f verenler insan akl\u0131n\u0131n erebilece\u011fi en \u00fcst d\u00fczey g\u00fcvenlik \u00f6nlemlerini uygulamaya mecbur edilmelidirler.<\/p>\n<p>\u00c7al\u0131\u015fanlar\u0131n\u0131n veya kurumun etki alan\u0131nda bulunan insanlar\u0131n sa\u011fl\u0131klar\u0131 kaybetmelerini g\u00f6ze alarak g\u00f6z g\u00f6re g\u00f6re kar\u0131n\u0131 art\u0131ran yat\u0131r\u0131mc\u0131 ve y\u00f6netici\u00a0katil muamelesi g\u00f6rmelidir. Buna kar\u015f\u0131l\u0131k i\u015f yerinde g\u00fcvenli\u011fe \u00f6nem g\u00f6steren i\u015f verenler ise te\u015fvik edilmelidir.<\/p>\n<h2><strong><em>Personel temsilcili\u011fi<\/em><\/strong><\/h2>\n<p>10 ki\u015fiden fazla \u00e7al\u0131\u015fan\u0131 olan kurumlarda \u00e7al\u0131\u015fanlar\u0131n \u2018personel temsilcisi kurulu\u2019 se\u00e7me hakk\u0131 olmal\u0131d\u0131r. Kurumun personel say\u0131s\u0131 do\u011frultusunda bu kurul bir veya bir \u00e7ok ki\u015fiden olu\u015fabilir. Kurulun sorumluluklar\u0131 i\u015f veren veya kurum y\u00f6neticiler ile personelin ili\u015fkisini d\u00fczenlemek ve uyum i\u00e7inde ge\u00e7mesini sa\u011flamakt\u0131r. Kurulun mensuplar\u0131 g\u00f6revde bulunduklar\u0131 s\u00fcre ve akabinde gelen 5 sene i\u00e7in i\u015ften \u00e7\u0131kar\u0131lmaktan muaf olmal\u0131d\u0131r.<\/p>\n<h2><em><strong>Tatil ve \u0130zinler<\/strong><\/em><\/h2>\n<p>Her personelin y\u0131lda en az 20 en fazla 30 i\u015f g\u00fcn\u00fc \u00fccretli tatil alma hakk\u0131 olmal\u0131d\u0131r. Bu say\u0131 sendikalar ve i\u015f verenlerin yapaca\u011f\u0131 pazarl\u0131kta belirlenir. Bu tatil g\u00fcnlerinin en az 10\u2019u y\u0131lda bir kere tek par\u00e7ada kullan\u0131lmal\u0131d\u0131r.<\/p>\n<p>Genel olarak ne zaman kullan\u0131labilece\u011fine dair son s\u00f6z hakk\u0131 i\u015f verende olmal\u0131, lakin okul ya\u015f\u0131nda \u00e7ocu\u011fu olan personele \u00f6ncelik tan\u0131nmal\u0131d\u0131r. Bunun haricinde \u00e7al\u0131\u015fanlar\u0131n ailelerinde birinci dereceden cenaze veya do\u011fum gibi olaylarda genel tatil haklar\u0131 haricinde iki g\u00fcn izin kullanma haklar\u0131 olmal\u0131d\u0131r. \u00c7al\u0131\u015fanlar\u0131n bu tatil hakk\u0131 haricinde hangi g\u00fcne denk geldikleri \u00f6nem arz etmeden \u00fclke \u00e7ap\u0131nda milli bayram, matem ve anma g\u00fcnleri birer g\u00fcn, Ramazan Bayram\u0131 \u00fc\u00e7 g\u00fcn, Kurban Bayram\u0131 d\u00f6rt g\u00fcn izin olmal\u0131d\u0131r.<\/p>\n<p>Personel hastaland\u0131\u011f\u0131 durumda i\u015f yerine haber vererek evde kalma hakk\u0131na sahiptir. Hastal\u0131\u011f\u0131 pe\u015f pe\u015fe 3 g\u00fcn (buna hafta sonu da dahil edilmelidir) veya fazla s\u00fcrerse personelin i\u015f yerine kendi haber vermesi kafi olmayarak \u00fc\u00e7\u00fcnc\u00fc g\u00fcn\u00fcn sonuna (hafta sonuna denk geliyorsa 4. g\u00fcn\u00fcn ba\u015flang\u0131c\u0131na) kadar i\u015f yerine doktordan rapor ula\u015ft\u0131r\u0131lmal\u0131d\u0131r. Personelin tek par\u00e7ada 6\u00a0hafta veya fazla hastalanmas\u0131 durumunda personelin maa\u015f\u0131 hastal\u0131\u011f\u0131 ge\u00e7ene kadar i\u015f vereni taraf\u0131ndan de\u011fil br\u00fct maa\u015f\u0131n \u00be\u2019\u00fc, (net maa\u015f\u0131n\u0131n %90\u2019\u0131n\u0131 ge\u00e7memek \u015fart\u0131yla) olarak sa\u011fl\u0131k sigortas\u0131 taraf\u0131ndan \u00f6denmelidir.<\/p>\n<p>Hastal\u0131k durumu 6 aydan fazla s\u00fcren ve i\u015fe d\u00f6nebilece\u011fi tarih gelecek 24 ay i\u00e7in doktorlar taraf\u0131ndan belirlenemeyen veya 55 ya\u015f\u0131ndan gen\u00e7lerde 3 y\u0131lda toplam 36 haftadan, 55 ya\u015f\u0131ndan b\u00fcy\u00fcklerde 3 y\u0131lda 44 haftadan fazla hastalanan ve kesintisiz i\u015f hayat\u0131na kat\u0131labilmesi gelecek 12 ay i\u00e7in belirlenemeyen personel emeklili\u011fine 5 y\u0131ldan az kalm\u0131\u015fsa i\u015f veren taraf\u0131ndan sunulan erken emeklilik modellerini kabul edilmelidir veya emeklili\u011fine 5 y\u0131ldan fazla kalm\u0131\u015fsa i\u015f veren taraf\u0131ndan i\u015ften \u00e7\u0131kar\u0131labilmelidir. \u015eayet personelin sa\u011fl\u0131\u011f\u0131 yapt\u0131\u011f\u0131 i\u015f gere\u011fi bozulduysa i\u015f veren bunun tazminat\u0131n\u0131 personeli i\u015ften \u00e7\u0131karsa da \u00e7\u0131karmasa da \u00f6demelidir. Ayn\u0131 i\u015fi ayn\u0131 \u015fartlar alt\u0131nda yapan elemanlar cinsiyet ayr\u0131m\u0131 olmadan ayn\u0131 maa\u015f grubuna dahil olmal\u0131d\u0131rlar. Kad\u0131n elemanlar\u0131n hamilelik durumlar\u0131nda do\u011fuma 3 ay kala \u00fccretli izine ayr\u0131lma hakk\u0131 olmal\u0131d\u0131r. Do\u011fumdan sonra \u00e7ocuklar\u0131 \u00fc\u00e7 ya\u015f\u0131n\u0131 bitirene kadar \u00fccretsiz \u2018annelik\u2019 izin haklar\u0131 olmal\u0131d\u0131r. \u0130\u015f veren annelik izninden geri d\u00f6nen \u00e7al\u0131\u015fan\u0131na ya eskiden yapt\u0131\u011f\u0131 ayn\u0131 i\u015fi ya da e\u015f de\u011ferde ba\u015fka bir i\u015f vermelidir. Annelik izninden geri d\u00f6nen kad\u0131n elemanlar\u0131n \u00fccretlerinde azalma olmamas\u0131 denetlenmesi gereken hususlardand\u0131r.<\/p>\n<p>Personel say\u0131s\u0131 20\u2019yi ge\u00e7en kurumlar ya kendi kapsamlar\u0131nda kre\u015f bulundurmal\u0131d\u0131rlar, ya da bir kre\u015f ile \u00f6zel anla\u015fma yapma mecburiyetinde olmal\u0131d\u0131rlar. Ayr\u0131ca \u00e7a\u011f\u0131m\u0131z\u0131n teknolojisinden faydalanarak \u00f6ncelikle yeni anneler olmak \u00fczere cinsiyet ayr\u0131m\u0131 yapmadan bir \u00e7ok ki\u015fiye evinden \u00e7al\u0131\u015fma imkan\u0131 sa\u011flanabilir, \u00f6zellikle masa ba\u015f\u0131 yap\u0131lan i\u015flerin bir \u00e7o\u011fu i\u00e7in i\u015f yerinde bulunmak muhakkak gerekli de\u011fildir. Bu gerek i\u015f verenin masraf\u0131n\u0131 ciddi boyutta d\u00fc\u015f\u00fcrebilir, gerekse \u00e7al\u0131\u015fanlar\u0131n daha uyumlu i\u015f &#8211; \u00f6zel hayat uyumu i\u00e7inde olmalar\u0131n\u0131 sa\u011flar.<\/p>\n<h2><strong>\u0130\u015ften \u00e7\u0131karma<\/strong><\/h2>\n<p>Kurumlar\u0131n ekonomik s\u0131k\u0131nt\u0131 \u00e7ekti\u011fi d\u00f6nemlerde bile i\u015ften personel \u00e7\u0131karma son \u00e7are olmal\u0131d\u0131r. Kurum y\u00f6neticileri ticari kararlar\u0131n\u0131 bu durumu g\u00f6z \u00f6n\u00fcnde bulundurarak vermeli, gelece\u011fe dair planlar\u0131n\u0131 bu kapsamda yapmal\u0131d\u0131rlar.<\/p>\n<p>Kurum ticari faaliyet g\u00f6steremez hale gelmesi haricindeki durumlar i\u00e7in, personel \u00e7\u0131karma \u00f6zel bir i\u015f alan\u0131nda faaliyet g\u00f6sterilmedi\u011fi takdirde m\u00fcmk\u00fcn olabilir. Bu durumlarda kurum a\u00e7\u0131kta kalan personeli kendi b\u00fcnyesinde personelin e\u011fitimi ve kabiliyeti do\u011frultusunda ba\u015fka alanlarda de\u011ferlendirmeye \u00e7al\u0131\u015fmal\u0131 gerekirse bunun i\u00e7in ek e\u011fitim imkanlar\u0131 sunmal\u0131d\u0131r. \u00c7al\u0131\u015fanlar\u0131n\u00a0buna itiraz hakk\u0131 bulunmamal\u0131d\u0131r. B\u00f6yle bir durumda personelin \u00fccretinde azalma olmamal\u0131; e\u011fer \u00e7ok gerekliyse\u00a0aradaki fark en az 5 sene i\u00e7in telafi edilmelidir. Bu \u00e7abalara ra\u011fmen hala personel fazlas\u0131 varsa, \u00f6ncelikli olarak \u00e7ocu\u011fu olmayanlar, aile kurmam\u0131\u015f olanlar \u00e7\u0131kar\u0131lmal\u0131d\u0131r. Lakin personel \u00e7\u0131karmaya gelmeden \u00f6nce emeklilik ya\u015f\u0131na yakla\u015fm\u0131\u015f olanlara \u00f6ncelik tan\u0131yarak bir t\u00fcr erken emeklilik veya benzeri modeller d\u00fc\u015f\u00fcn\u00fclmelidir. \u0130\u015ften \u00e7\u0131kar\u0131lan personelin tazminat hakk\u0131 vard\u0131r. Bu kurumda \u00e7al\u0131\u015ft\u0131\u011f\u0131 her sene i\u00e7in en az 1,5 ayl\u0131k maa\u015f olmal\u0131d\u0131r. \u00c7al\u0131\u015ft\u0131\u011f\u0131 s\u00fcrece kurumunun kar\u0131na olan ortakl\u0131\u011f\u0131 bu hesaba dahil edilmez. \u0130\u015fine son verilen personel hesapta biriken kar ortakl\u0131\u011f\u0131n\u0131 kesintisiz alma hakk\u0131na sahip olmal\u0131d\u0131r.
