Bug\u00fcne dek \u00f6ng\u00f6r\u00fclenden tamamen farkl\u0131 bir \u00e7\u00f6z\u00fcm modeli \u00fczerinde konu\u015fman\u0131n m\u00fcmk\u00fcn olabilece\u011fi yeni bir zemin s\u00f6z konusu.\u00a0 Ada etraf\u0131nda ke\u015ffedilen hidrokarbon yataklar\u0131 ve bunun \u00e7\u0131kar\u0131lmas\u0131 s\u00fcrecine e\u015flik eden egemenlik tesisindeki anla\u015fmazl\u0131k, bir noktadan sonra K\u0131br\u0131s\u2019taki fiili iki devletli yap\u0131n\u0131n durumunu a\u00e7\u0131kl\u0131\u011fa kavu\u015fturmay\u0131 zorunluluk haline getirdi. M\u00fczakere s\u00fcrecinden ba\u011f\u0131ms\u0131z olarak K\u0131br\u0131s a\u00e7\u0131klar\u0131nda \u00e7\u0131kar\u0131lacak do\u011falgaz\u0131n Avrupa\u2019ya ula\u015ft\u0131r\u0131lmas\u0131nda gelinen a\u015fama, Rum taraf\u0131n\u0131, Ada T\u00fcrkleriyle sorunlar\u0131ndan kurtulmaya zorluyor. \u00a0Bunun iki nedeni bulunuyor. \u00a0\u0130lk neden, sondaj faaliyetlerini y\u00fcr\u00fcten uluslararas\u0131 \u015firketlerin b\u00f6lgedeki kriz ortam\u0131ndan duydu\u011fu rahats\u0131zl\u0131kt\u0131r. \u0130kinci neden, g\u00fcnden g\u00fcne yakla\u015ft\u0131klar\u0131 enerji zenginli\u011fini kendileri gibi zenginlikte hak sahibi olan T\u00fcrklerle payla\u015fmak istememeleridir. Rum lider Nikos Anastasiadis\u2019in yetki payla\u015f\u0131m\u0131na ili\u015fkin son d\u00f6nemdeki a\u00e7\u0131klamalar\u0131, \u00e7\u00f6z\u00fcm perspektifinin de\u011fi\u015fti\u011fini ve hidrokarbon zenginli\u011finin \u00f6n\u00fcndeki engelleri a\u015fmak ad\u0131na m\u00fczakereler i\u00e7in kestirme bir yol yaratmaya \u00e7al\u0131\u015ft\u0131\u011f\u0131n\u0131 g\u00f6steriyor. Ger\u00e7i bu a\u00e7\u0131klamadaki unsurlar, Rum taraf\u0131n\u0131n zaten ba\u015f\u0131ndan bu yana m\u00fczakerelerde varmak istedi\u011fi noktayd\u0131. O anlamda yeni de\u011fil. Ancak birden bire aradaki m\u00fczakereleri, buradan \u00e7\u0131kan sonu\u00e7lar\u0131, kriterleri, uzla\u015f\u0131 noktalar\u0131n\u0131 yok sayarak t\u00fcm s\u00fcreci 58 y\u0131l \u00f6ncesine g\u00f6t\u00fcrmesi ve bu anlamda sonu\u00e7lar\u0131n\u0131 g\u00f6ze almas\u0131 yeni bir durum. T\u00fcrkiye\u2019nin 8 y\u0131l s\u00fcren sismik ara\u015ft\u0131rma a\u015famas\u0131ndan kendi k\u0131ta sahanl\u0131\u011f\u0131nda sondaj a\u015famas\u0131na ge\u00e7mesinin Rum taraf\u0131n\u0131n m\u00fczakere s\u00fcrecinden h\u0131zl\u0131ca kurtulma giri\u015fimini tetikledi\u011fini d\u00fc\u015f\u00fcn\u00fcyoruz.<\/p>\n<h2><strong>Do\u011fu Akdeniz egemenlik sava\u015f\u0131<\/strong><\/h2>\n<p>Do\u011fu Akdeniz\u2019de hidrokarbon yataklar\u0131n\u0131n bulunmas\u0131 ve uluslararas\u0131 \u015firketlerin devreye girmesi meselenin daha \u00e7ok enerji aya\u011f\u0131na dayan\u0131r bir yap\u0131ya b\u00fcr\u00fcnmesine neden oldu. H\u00e2lbuki konunun can damar\u0131, deniz egemenlik b\u00f6lgeleri ve denizlerdeki yetki alanlar\u0131d\u0131r. \u00d6ncelikle bir b\u00f6lge i\u00e7in iki hak iddias\u0131 varsa o b\u00f6lgedeki zenginli\u011fin \u00e7\u0131kar\u0131lmas\u0131, ta\u015f\u0131nmas\u0131, payla\u015f\u0131lmas\u0131 i\u00e7in hak iddias\u0131nda iki taraf\u00e7a da kabul edilecek bir uzla\u015f\u0131n\u0131n sa\u011flanmas\u0131 gerekir.\u00a0 Dolay\u0131s\u0131yla GKRY 30 ayr\u0131 \u00fclkeden 60 \u015firketle de anla\u015fma yapsa T\u00fcrkiye\u2019nin arama ve sondaj yap\u0131lacak b\u00f6lgede hak iddias\u0131 oldu\u011fu m\u00fcddet\u00e7e Do\u011fu Akdeniz bir kriz alan\u0131 halini korur. \u00d6te yandan GKRY\u2019nin t\u0131pk\u0131 \u0130srail gibi esasen uluslararas\u0131 dola\u015f\u0131ma a\u00e7\u0131k sular olan MEB alan\u0131nda karasular\u0131 hukukunu uygulama giri\u015fimi de konunun egemenlik tesisi noktas\u0131ndan ele al\u0131nmas\u0131n\u0131 zorunlu k\u0131lar.<\/p>\n<p>Bu anlamda T\u00fcrkiye\u2019nin belli bir s\u00fcre k\u0131smen\/g\u00f6receli esneklik tan\u0131mas\u0131n\u0131, K\u0131br\u0131s T\u00fcrklerinin pay\u0131n\u0131n verilece\u011fi garantisine ve \u0130srail\u2019in GKRY\u2019yi \u00e7\u0131kan do\u011falgaz\u0131n T\u00fcrkiye \u00fczerinden ta\u015f\u0131nmas\u0131na zorlayaca\u011f\u0131 varsay\u0131m\u0131na, sondaj\u0131n ba\u015flang\u0131\u00e7ta sadece \u0130srail ve GKRY aras\u0131ndaki b\u00f6lgede yap\u0131lmas\u0131na, devam etmekte olan K\u0131br\u0131s m\u00fczakerelerine zarar vermeme niyetine ba\u011flayabiliriz.<a href=\"#_ftn1\" name=\"_ftnref1\">[1]<\/a> Ancak Rum taraf\u0131n\u0131n m\u00fczakere s\u00fcrecinde hi\u00e7bir iyi niyet ve uzla\u015f\u0131 e\u011filimi sergilememesi, sonraki s\u00fcre\u00e7te de K\u0131br\u0131sl\u0131 T\u00fcrkleri ve haklar\u0131n\u0131 yok farz eden bir tutuma girmesi, do\u011falgaz boru hatt\u0131 anla\u015fmas\u0131na Romanya ve Bulgaristan\u2019\u0131n da Kas\u0131m 2018\u2019de dahil edilmesi,<a href=\"#_ftn2\" name=\"_ftnref2\">[2]<\/a> Yunanistan\u2019\u0131n Ege\u2019deki hareketlili\u011finin T\u00fcrkiye\u2019nin egemenlik haklar\u0131n\u0131 hedef ald\u0131\u011f\u0131n\u0131n ve Do\u011fu Akdeniz\u2019e de ta\u015ft\u0131\u011f\u0131n\u0131n a\u015fikar hale gelmesi, GKRY\u2019nin yeni sondaj alanlar\u0131n\u0131n art\u0131k do\u011frudan T\u00fcrkiye\u2019nin egemenlik alanlar\u0131yla \u00e7ak\u0131\u015fmas\u0131 ise durumu de\u011fi\u015ftirdi. T\u00fcrkiye\u2019nin zaman i\u00e7inde yumu\u015famas\u0131 beklenirken aksine sertle\u015fti\u011fi ve hak ihlaline g\u00f6z yummama kararl\u0131l\u0131\u011f\u0131n\u0131 kuvvetlendirdi\u011fi Rum taraf\u0131nca anla\u015f\u0131l\u0131r hale geldi.<\/p>\n<p>T\u00fcrkiye, Do\u011fu Akdeniz\u2019deki egemenlik haklar\u0131n\u0131 koruma konusunda kararl\u0131 davran\u0131yor. Kararl\u0131\u011f\u0131n\u0131 yapt\u0131\u011f\u0131 \u00f6nleme hareketleri ve ald\u0131\u011f\u0131 sondaj gemileri de peki\u015ftiriyor. T\u00fcrkiye, Rum Y\u00f6netimi\u2019nin uluslararas\u0131 hukukun \u00f6ng\u00f6rd\u00fc\u011f\u00fc gibi t\u00fcm k\u0131y\u0131da\u015f devletlerin uzla\u015f\u0131s\u0131n\u0131 aramak yerine M\u0131s\u0131r ve \u0130srail\u2019le yapt\u0131\u011f\u0131 ikili anla\u015fmalara dayanan MEB ilan\u0131n\u0131 ba\u015f\u0131ndan bu yana tan\u0131mad\u0131, t\u00fcm eylemleriyle de tan\u0131mad\u0131\u011f\u0131n\u0131 g\u00f6sterdi.<a href=\"#_ftn3\" name=\"_ftnref3\">[3]<\/a> T\u00fcrkiye\u2019nin bu ilan\u0131 tan\u0131mamas\u0131n\u0131n bir sebebi hukuka ayr\u0131l\u0131k, di\u011fer sebebi ise s\u00f6z konusu b\u00f6lgenin pek \u00e7ok noktada T\u00fcrkiye\u2019nin k\u0131ta sahanl\u0131\u011f\u0131 ile \u00f6rt\u00fc\u015fmesi. GKRY\u2019nin parselledi\u011fi 1, 4, 5, 6, 7. b\u00f6lgeler, T\u00fcrkiye\u2019nin k\u0131ta sahanl\u0131\u011f\u0131 ve T\u00fcrkiye\u2019nin TPAO\u2019ya verdi\u011fi petrol-do\u011falgaz arama ruhsat\u0131 b\u00f6lgeleri ile \u00e7ak\u0131\u015fmaktad\u0131r. \u00a0GKRY\u2019nin parselledi\u011fi bu say\u0131l\u0131 alanlar\u0131n y\u00fczde 30\u2019unun \u00fczerindeki bir b\u00f6lgede T\u00fcrkiye\u2019nin hak iddias\u0131 bulunuyor. GKRY\u2019nin parselledi\u011fi 1, 2, 3, 8, 9, 12 ve 13. b\u00f6lgeler de KKTC\u2019nin TPAO\u2019ya Eyl\u00fcl 2011\u2019de verdi\u011fi<a href=\"#_ftn4\" name=\"_ftnref4\">[4]<\/a> ruhsat b\u00f6lgeleriyle \u00e7ak\u0131\u015fmaktad\u0131r.<\/p>\n<p>T\u00fcrkiye\u2019nin MEB ilan\u0131, parselleme, ruhsatland\u0131rma ve nihayetinde sondaj faaliyetlerine kar\u015f\u0131 \u00e7\u0131k\u0131\u015f\u0131n\u0131n bir di\u011fer nedeni de Ada\u2019n\u0131n b\u00fct\u00fcn\u00fc \u00fczerinde Rumlarla e\u015fit \u015fekilde s\u00f6z sahibi olan T\u00fcrklerin GKRY\u2019ce karar s\u00fcrecine d\u00e2hil edilmemesidir. Yani Rumlar\u0131n iki ba\u015fl\u0131 olu\u015fturulmu\u015f devlet mekanizmas\u0131 ad\u0131na ama tek ba\u015f\u0131na hareket etmesine d\u00f6n\u00fck bir tepki ve reddedi\u015f s\u00f6z konusudur. T\u00fcrkiye\u2019nin ve KKTC\u2019nin bu y\u00f6ndeki itiraz\u0131n\u0131n hukuki temeli net ve a\u00e7\u0131kt\u0131r. Nitekim GKRY de 1959-1960 Anla\u015fmalar\u0131, bu anla\u015fmalara dayal\u0131 kurulan 1960 K\u0131br\u0131s Cumhuriyeti\u2019nin Anayasas\u0131 ve bu nihai noktaya var\u0131ncaya dek geli\u015fim g\u00f6steren t\u00fcm hukuki s\u00fcre\u00e7te K\u0131br\u0131sl\u0131 T\u00fcrklerin Ada\u2019ya ait zenginliklerin orta\u011f\u0131 oldu\u011funu kabul etmektedir. Zenginli\u011fin payla\u015f\u0131m\u0131n\u0131 ise sonraya, m\u00fczakere s\u00fcrecinden sonraya \u00f6telemektedir. Payla\u015f\u0131m\u0131n oran\u0131 hakk\u0131nda ise hi\u00e7bir bilgi, a\u00e7\u0131klama, ima bulunmamaktad\u0131r. Ancak ruhsat da\u011f\u0131tma karar\u0131ndan geri ad\u0131m atm\u0131\u015f de\u011fildir.<\/p>\n<p>KKTC\u2019nin TPAO\u2019ya petrol ve do\u011falgaz arama ruhsat\u0131 vermesi bu hususla ilgilidir. \u0130ki \u00fclkenin bu hususta ciddi oldu\u011funu GKRY, \u0130talyan EN\u0130 \u015firketinin Rumlarca hukuka ayk\u0131r\u0131 ruhsatlanm\u0131\u015f 3. parseldeki sondaj faaliyetine d\u00f6n\u00fck ilerleyi\u015finin T\u00fcrkiye taraf\u0131ndan durdurulmas\u0131yla anlam\u0131\u015f bulunuyor.\u00a0 EN\u0130 \u015firketine ait Saipem 12000 T\u00fcrk sava\u015f gemilerince 9-24 \u015eubat 2018 boyunca engellenince Limasal liman\u0131na y\u00f6nelip, birka\u00e7 g\u00fcn sonra da Fas\u2019a hareket etmi\u015f; sondaj planlar\u0131 da ertelenmi\u015fti.<a href=\"#_ftn5\" name=\"_ftnref5\">[5]<\/a> 3. parsel, KKTC\u2019nin TPAO\u2019ya ruhsat verdi\u011fi b\u00f6lgelerden biriydi. 18 Ekim 2018\u2019de ise Do\u011fu Akdeniz&#8217;de \u00f6nceden ilan edilen T\u00fcrkiye&#8217;ye ait G\u00fczelyurt Ara\u015ft\u0131rma Sahas\u0131&#8217;nda ara\u015ft\u0131rma yapan Barbaros Hayrettin Pa\u015fa gemisini taciz eden Yunan f\u0131rkateyni, Deniz Kuvvetleri Komutanl\u0131\u011f\u0131 unsurlar\u0131nca<a href=\"#_ftn6\" name=\"_ftnref6\">[6]<\/a> engellenmi\u015fti.<a href=\"#_ftn7\" name=\"_ftnref7\">[7]<\/a> Dolay\u0131s\u0131yla T\u00fcrkiye\u2019nin \u00f6nleme faaliyetlerinin hidrokarbon zenginli\u011fine ula\u015fmada \u00f6nemli bir engel te\u015fkil etti\u011fini ancak T\u00fcrkiye\u2019nin sondajlar\u0131n\u0131n \u00f6nlenmesinde yetersiz kal\u0131nd\u0131\u011f\u0131n\u0131 Rum Y\u00f6netimi g\u00f6rd\u00fc.<\/p>\n<p>\u00d6te yandan Oru\u00e7 Reis ve Barbaros Hayreddin Pa\u015fa gemileriyle sismik ara\u015ft\u0131rmalara devam eden T\u00fcrkiye\u2019nin derin denizde Fatih gemisiyle ba\u015flatt\u0131\u011f\u0131 petrol ve do\u011fal gaz arama \u00e7al\u0131\u015fmalar\u0131 ve yeni al\u0131nan ikinci sondaj gemisinin de Aral\u0131k ay\u0131ndan itibaren sondaja ba\u015flayacak olmas\u0131, GKRY\u2019nin ba\u015flang\u0131\u00e7ta \u00e7\u00f6z\u00fclmemi\u015f egemenlik alan\u0131 sorununun ba\u015f\u0131n\u0131 a\u011fr\u0131taca\u011f\u0131n\u0131 anlamas\u0131n\u0131 sa\u011flam\u0131\u015ft\u0131r. K\u0131br\u0131s Rum Y\u00f6netimi, hidrokarbon yataklar\u0131ndaki \u00e7al\u0131\u015fmalarda ileriye gidebilmek i\u00e7in kendini bir \u00e7\u00f6z\u00fcm bulmak zorunda hissediyor.<\/p>\n<h2><strong>Anastasiadis\u2019in \u00f6nerisi<\/strong><\/h2>\n<p>K\u0131br\u0131s Rum taraf\u0131n\u0131n 50 y\u0131ll\u0131k m\u00fczakere s\u00fcrecinde bir anlamda T\u00fcrklerin kazan\u0131m\u0131 olarak g\u00f6rd\u00fc\u011f\u00fc \u201ciki kesimlili\u011fin korunmas\u0131\u201d,<a href=\"#_ftn8\" name=\"_ftnref8\">[8]<\/a> \u201cm\u00fclkiyette global takas ve tazminat\u201d<a href=\"#_ftn9\" name=\"_ftnref9\">[9]<\/a> ilkelerini art\u0131k tan\u0131mad\u0131\u011f\u0131 gibi<a href=\"#_ftn10\" name=\"_ftnref10\">[10]<\/a> 1960 Anayasas\u0131\u2019na da asla d\u00f6nmeyece\u011fini a\u00e7\u0131klamas\u0131 ve Rum lider Anastasiadis\u2019in yeni \u00f6nerisiyle s\u00fcrecin art\u0131k ba\u015fka bir yola s\u00fcr\u00fcklendi\u011fi anla\u015f\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>Rum Y\u00f6netimi\u2019nin yeni yakla\u015f\u0131m\u0131 \u00f6nce Rum bas\u0131n\u0131na s\u0131zan 10 sayfal\u0131k bir a\u00e7\u0131klama, ard\u0131ndan m\u00fczakere heyeti \u00fcyesi ve Anastasiadis\u2019in dan\u0131\u015fman\u0131 Poliviu\u2019nun haz\u0131rlad\u0131\u011f\u0131 37 sayfal\u0131k raporla g\u00fcndeme geldi; zaten k\u0131sa s\u00fcre sonra Kas\u0131m 2018 i\u00e7inde bas\u0131n a\u00e7\u0131klamalar\u0131yla Anastasiadis de yeni yakla\u015f\u0131m\u0131n ayr\u0131nt\u0131lar\u0131n\u0131 payla\u015ft\u0131. Buna g\u00f6re Anastasiadis, ilke olarak K\u0131br\u0131sl\u0131 T\u00fcrklerin y\u00f6netime e\u015fit kat\u0131l\u0131m\u0131n\u0131 sa\u011flamas\u0131 gereken d\u00fczenlemelerin tamam\u0131n\u0131 reddediyordu.\u00a0 \u00d6nerisi \u201cdesantralize federasyon\u201ddu. T\u00fcrklerin t\u00fcm organlarda karar alma mekanizmalar\u0131na etkin kat\u0131l\u0131m\u0131n\u0131n devleti \u00e7al\u0131\u015fmaz hale getirece\u011fini, \u00a0kararlarda T\u00fcrklerin etkin kat\u0131l\u0131m\u0131n\u0131 araman\u0131n az\u0131nl\u0131\u011f\u0131 bu hakk\u0131n\u0131 k\u00f6t\u00fcye kullanmas\u0131 ve \u00e7o\u011funlu\u011fun hakk\u0131n\u0131 engellemesi tehlikesini do\u011furdu\u011funu savunan Anastasiadis, T\u00fcrklerin sadece hayati \u00e7\u0131karlar\u0131n\u0131 etkileyecek kararlarda oy kullanabileceklerini s\u00f6yledi. T\u00fcrklerin kendi b\u00f6lgelerindeki y\u00f6netim yetkilerinin artt\u0131r\u0131lmas\u0131 kar\u015f\u0131l\u0131\u011f\u0131nda merkezi y\u00f6netimdeki yetkilerinin azalt\u0131lmas\u0131n\u0131 yeni m\u00fczakerelerin ba\u015flamas\u0131 i\u00e7in \u015fart ko\u015fuyordu.<a href=\"#_ftn11\" name=\"_ftnref11\">[11]<\/a><\/p>\n<p>Gev\u015fek federasyon \u015feklinde tan\u0131ml\u0131yorsa da asl\u0131nda \u00f6nerisi \u00fcniter bir devlet i\u00e7erisinde T\u00fcrklere \u00f6zerklik\/otonom hakk\u0131 tan\u0131nmas\u0131yd\u0131. A\u00e7\u0131k\u00e7as\u0131 bu, aradan ge\u00e7en y\u0131llara, m\u00fczakerelerde ula\u015f\u0131lan kriterlere ra\u011fmen 1963\u2019te devletin y\u0131k\u0131lmas\u0131 ve T\u00fcrklere kar\u015f\u0131 katliamlar\u0131n ba\u015flamas\u0131ndaki bak\u0131\u015f a\u00e7\u0131s\u0131n\u0131n canl\u0131l\u0131\u011f\u0131n\u0131 korudu\u011funu g\u00f6steriyor. Bu yakla\u015f\u0131mda T\u00fcrkler az\u0131nl\u0131k olarak kabul ediliyor ve bir hukuki s\u00fcre\u00e7le edinilmi\u015f olan siyasal e\u015fitlik hakk\u0131 yok say\u0131l\u0131yor. Yeni \u00f6neriye g\u00f6re, T\u00fcrklerin ayr\u0131 bir meclisi, h\u00fck\u00fcmeti, cumhurba\u015fkan\u0131, e\u011fitim ve mali kurumlar\u0131, harita \u00fczerinde idari s\u0131n\u0131rlar\u0131, polisi olacak, ba\u015fka \u00fclkelerle ticaret ve ikili anla\u015fmalar yapabilecekler ama egemen olamayacaklar ve egemen devletin kararlar\u0131na da kat\u0131lamayacaklar. Ayn\u0131 zamanda T\u00fcrklere b\u0131rak\u0131lan s\u0131n\u0131rlara Rumlar\u0131n ya da Yunanlar dahil 25 AB \u00fcyesi vatanda\u015flar\u0131n dola\u015fma, yerle\u015fme, i\u015f kurma, m\u00fclk edinme haklar\u0131 da (d\u00f6rt \u00f6zg\u00fcrl\u00fck) olaca\u011f\u0131 i\u00e7in buran\u0131n demografik yap\u0131s\u0131 de\u011fi\u015fime a\u00e7\u0131k olacakt\u0131r. Art\u0131k bir devlet ve i\u00e7inde ya\u015famas\u0131na izin verilen bir toplum \u00f6nerisi masaya konulmak istenmektedir.<\/p>\n<p>M\u00fczakere masas\u0131n\u0131n yeniden kurulmas\u0131nda \u00e7ok istekli davranan KKTC Cumhurba\u015fkan\u0131 Mustafa Ak\u0131nc\u0131 bile bu \u00f6nerinin \u00fcniter devlet anlam\u0131na geldi\u011fini, merkezi h\u00fck\u00fcmette kalacak yetkilerin uygulanmas\u0131nda kararlar\u0131n basit \u00e7o\u011funluk esas\u0131nda al\u0131nmas\u0131n\u0131 kabul etmeyeceklerini belirtti. \u00a0Ancak m\u00fczakerelerde yeni bir model teklifi zaman\u0131 geldi\u011fini hen\u00fcz kabul etmedi.<\/p>\n<h2><strong>\u0130ki ayr\u0131 devlet modeli<\/strong><\/h2>\n<p>S\u00fcre\u00e7 T\u00fcrkleri iki ayr\u0131 devlet modelinde \u0131srar etmeye zorluyor. Di\u011fer bir deyi\u015fle BM\u2019nin iyi niyet misyonu hidrokarbon meselesinin esiri olmu\u015ftur. Anastasiadis\u2019in desantralize federasyon \u00f6nerisini a\u00e7\u0131klarken do\u011falgaz konusunu asla m\u00fczakere masas\u0131na getirmeyeceklerini de s\u00f6yledi.\u00a0 Norve\u00e7 modelini savundu ve gazdan elde edilecek gelirin bir banka hesab\u0131na konulaca\u011f\u0131 ve \u00e7\u00f6z\u00fcmden sonra de\u011ferlendirilece\u011fini s\u00f6yledi. Gelinen nokta, KKTC\u2019nin en zay\u0131f g\u00f6r\u00fcnd\u00fc\u011f\u00fc anda asl\u0131nda en avantajl\u0131 konumda oldu\u011fu iddias\u0131n\u0131 belirtmemizi m\u00fcmk\u00fcn k\u0131l\u0131yor. \u00a0\u015eimdi tamamen yeni bir yakla\u015f\u0131m\u0131 g\u00fcndeme getirme s\u0131ras\u0131 KKTC\u2019de.<\/p>\n<p>\u0130\u015fleyen demokrasisi ve bir yap\u0131y\u0131 devlet yapan t\u00fcm kurumlara sahip konumuyla KKTC, varl\u0131\u011f\u0131n\u0131 koruma ve devletten geriye gidilemeyece\u011fi inanc\u0131yla art\u0131k tan\u0131nma denizine yelken a\u00e7mak, diplomasi giri\u015fimlerini ba\u015flatmak zorundad\u0131r. Ada\u2019da iki halk, iki ayr\u0131 egemen ve ba\u011f\u0131ms\u0131z devlet var ve Ada\u2019n\u0131n ger\u00e7eklerine uygun bir \u00e7\u00f6z\u00fcm aray\u0131\u015f\u0131 s\u00f6z konusu olmal\u0131d\u0131r. \u0130ki halk ileride ger\u00e7ek bir federasyon ya da konfederasyon \u00e7at\u0131s\u0131 alt\u0131nda birle\u015fmek isteyecekse bunun m\u00fczakeresi iki egemen ve ba\u011f\u0131ms\u0131z devlet aras\u0131nda yap\u0131lmal\u0131d\u0131r.<\/p>\n<p>T\u00fcrkiye, Temmuz 2017\u2019de son Cenevre Zirvesi de \u00e7\u00f6kt\u00fc\u011f\u00fcnde<a href=\"#_ftn12\" name=\"_ftnref12\">[12]<\/a> masadan kalkarken BM parametrelerinde \u0131srar etmenin anlam\u0131n\u0131n kalmad\u0131\u011f\u0131n\u0131 a\u00e7\u0131klam\u0131\u015ft\u0131. T\u00fcrkiye D\u0131\u015fi\u015fleri Bakan\u0131 Mevl\u00fct \u00c7avu\u015fo\u011flu\u2019nun 21 Nisan 2018\u2019de Ak\u0131nc\u0131 ve siyasi parti liderleriyle ger\u00e7ekle\u015ftirdi\u011fi toplant\u0131da \u201ckonfederasyon ya da iki ayr\u0131 devlet modeli \u00fczerinde durulmas\u0131 \u00f6nerisi\u201dnde bulundu\u011fu da bas\u0131na s\u0131zm\u0131\u015ft\u0131. Bu zaten KKTC kamuoyunun beklentisinin kar\u015f\u0131l\u0131\u011f\u0131yd\u0131, o nedenle b\u00fcy\u00fck ilgi g\u00f6rd\u00fc. KKTC Cumhurba\u015fkan\u0131 Ak\u0131nc\u0131 ise BM parametrelerinin \u00e7\u00f6pe at\u0131lmas\u0131n\u0131n kabul edilemeyece\u011fini s\u00f6yleyerek yeni m\u00fczakere masas\u0131n\u0131 zorlamaya \u00e7al\u0131\u015fmaktad\u0131r. H\u00e2lbuki art\u0131k zaten BM parametreleri kalmam\u0131\u015ft\u0131r. Rum taraf\u0131 da m\u00fczakere s\u00fcrecinde \u00f6nerdi\u011fi t\u00fcm teklifleri geri \u00e7ekti\u011fini a\u00e7\u0131klam\u0131\u015ft\u0131r.<\/p>\n<p>BM parametreleri dedi\u011fimizde her ne kadar iki kesimlilik ilkesi, siyasi e\u015fitlik gibi son 10 y\u0131lda par\u00e7a par\u00e7a eritilen en sonunda da Ak\u0131nc\u0131 d\u00f6neminde tamamen vazge\u00e7ilen ve taraflar\u0131n talepleri aras\u0131nda denge sa\u011flayabilecek unsurlar\u0131 da i\u00e7eren uzla\u015f\u0131lar b\u00fct\u00fcn\u00fc anla\u015f\u0131lsa da en son masadan kalk\u0131ld\u0131\u011f\u0131nda BM parametresi olarak geriye sadece 4 Mart 1964 tarihli ve 186 say\u0131l\u0131 BM G\u00fcvenlik Konseyi karar\u0131 kalm\u0131\u015ft\u0131. BM G\u00fcvenlik Konseyi\u2019nin 1960 K\u0131br\u0131s Cumhuriyeti Anayasas\u0131na ayk\u0131r\u0131 olarak sadece Rumlardan olu\u015fan bir kabineyi, \u201cK\u0131br\u0131s Cumhuriyeti\u2019nin\u201d K\u0131br\u0131s T\u00fcrk halk\u0131n\u0131 da temsil eden \u201ch\u00fck\u00fbmeti\u201d oldu\u011funu varsayan bu karar, s\u00f6zde BM bar\u0131\u015f g\u00fcc\u00fcn\u00fcn Ada\u2019ya davet edilmesi ko\u015fulunu kar\u015f\u0131lamak i\u00e7in al\u0131nm\u0131\u015ft\u0131 ancak sonraki s\u00fcrecin zemini yap\u0131ld\u0131. KKTC\u2019nin tan\u0131nmas\u0131 \u00e7a\u011f\u0131r\u0131s\u0131n\u0131 i\u00e7eren BM G\u00fcvenlik Konseyi\u2019nin 18 Kas\u0131m 1983 tarihli 541 say\u0131l\u0131 karar\u0131 da 186 say\u0131l\u0131 karar zemininde al\u0131nm\u0131\u015ft\u0131r. K\u0131sacas\u0131 186 say\u0131l\u0131 karar, Ada&#8217;daki Rum y\u00f6netiminin K\u0131br\u0131s T\u00fcrk&#8217;\u00fcn\u00fc de temsil etti\u011fini varsayar ve bu varsay\u0131mla ancak \u201cK\u0131br\u0131s Cumhuriyeti\u201d temelinde ve \u00e7at\u0131s\u0131 alt\u0131nda \u00e7\u00f6z\u00fcm \u00fcretebilir. Bu da adil bir sonu\u00e7 do\u011fmas\u0131n\u0131 imkans\u0131zla\u015ft\u0131r\u0131r. Gelinen noktada, T\u00fcrklerin haklar\u0131n\u0131 da koruyan t\u00fcm g\u00fcvencelerin kalkt\u0131\u011f\u0131, dolay\u0131s\u0131yla dengenin bozuldu\u011fu sadece 186 say\u0131l\u0131 karar\u0131n do\u011furdu\u011fu sonu\u00e7lar\u0131n esas oldu\u011fu bir BM zemini s\u00f6z konusudur. Bunun en \u00f6nemli sonucu m\u00fczakere masas\u0131na Rum taraf\u0131n\u0131n devlet olarak T\u00fcrk taraf\u0131n\u0131n ise toplum olarak oturmas\u0131d\u0131r.\u00a0 Halbuki Ada\u2019daki kaostan \u00e7\u0131k\u0131\u015f,\u00a0 iki halk, iki ayr\u0131 egemen ve ba\u011f\u0131ms\u0131z devlet oldu\u011fu ger\u00e7e\u011finden hareket edildi\u011finde sa\u011flanabilecektir.<\/p>\n<p>T\u00fcrkiye\u2019nin 2004\u2019te \u201cart\u0131k bu defter kapand\u0131\u201d dedikten sonra 2008\u2019de m\u00fczakerelerin yeniden ba\u015flamas\u0131na raz\u0131 olmas\u0131, en b\u00fcy\u00fck hatayd\u0131. Zira 2004\u2019te K\u0131br\u0131s m\u00fczakerelerinin varabilece\u011fi en \u00fcst noktaya ula\u015f\u0131lm\u0131\u015f, referanduma gidilebilmi\u015fti. Referandum son durak olmal\u0131yd\u0131. \u0130ki taraf da evet diyene dek defalarca sand\u0131k kurulmas\u0131 anlams\u0131z. Anlams\u0131zl\u0131\u011f\u0131n d\u00fcnya kamuoyuna anlat\u0131lmas\u0131 gerekir. \u00d6nceki ve sonraki s\u00fcre\u00e7 incelendi\u011finde, yeniden referanduma gidilebilecek bir plan\u0131n olu\u015fturulmas\u0131n\u0131 zorlayacak hakemlik ve takvim m\u00fcessesinin bir kez daha devreye sokulmas\u0131n\u0131n m\u00fcmk\u00fcn olmad\u0131\u011f\u0131 da g\u00f6r\u00fclmektedir. Rumlar kendileri i\u00e7in k\u0131s\u0131tlay\u0131c\u0131 g\u00f6rd\u00fckleri hakemlik ve takvim giri\u015fimine 2004\u2019ten sonra asla izin vermediler.<\/p>\n<p>Kald\u0131 ki Annan referandumu bize BM\u2019nin T\u00fcrklerin kendi kaderini tayin hakk\u0131n\u0131 ve KKTC\u2019nin devlet olarak yapt\u0131\u011f\u0131 i\u015flemleri tan\u0131d\u0131\u011f\u0131n\u0131 ve Rumlara da bunu kabul ettirdi\u011fini g\u00f6stermektedir. Referandumun e\u015f zamanl\u0131 ama iki tarafta ayr\u0131 ayr\u0131 ger\u00e7ekle\u015ftirilmesi T\u00fcrklerin Rumlardan ayr\u0131 bir halk oldu\u011funun kabul edildi\u011fini ve kendi kaderini tayin hakk\u0131n\u0131n da tan\u0131nd\u0131\u011f\u0131n\u0131 g\u00f6sterir. Annan Plan\u0131\u2019n\u0131n KKTC\u2019nin o g\u00fcne dek yapt\u0131\u011f\u0131 anla\u015fmalar\u0131n yeni devlet i\u00e7in ba\u011flay\u0131c\u0131 olaca\u011f\u0131 h\u00fckm\u00fc de KKTC\u2019nin icraatlar\u0131n\u0131n tan\u0131nd\u0131\u011f\u0131 yani devlet yap\u0131s\u0131n\u0131n kabul edildi\u011fi sonucuna g\u00f6t\u00fcr\u00fcr.<\/p>\n<p>Bug\u00fcn KKTC, tam ba\u011f\u0131ms\u0131z olarak kurulmu\u015f ve ilan edilmi\u015f bir devlet olarak en g\u00fc\u00e7l\u00fc pazarl\u0131\u011f\u0131n\u0131 yapabilecek konumdad\u0131r.
