Bu \u00f6zelli\u011fiyle Hititlerden ba\u015flayarak bir\u00e7ok kavim ve devlet, K\u0131br\u0131s&#8217;ta egemenlik kurmu\u015ftur. Bunlardan en \u00f6nemlileri adada s y\u0131l h\u00fck\u00fcm s\u00fcren ve bu s\u00fcre i\u00e7inde ada halk\u0131n\u0131 k\u00f6le gibi \u00e7al\u0131\u015ft\u0131rarak ezen Venedikliler(1), 1570-1571\u2019de 75.000 \u015fehit vererek aday\u0131 Venediklilerden alan ve 308 y\u0131l h\u00fck\u00fcm s\u00fcren Osmanl\u0131 \u0130mparatorlu\u011fu(2) ve aday\u0131 Rus tehdidine kar\u015f\u0131 Osmanl\u0131 Devleti\u2019ne yard\u0131m etme bahanesiyle kiralayan ve sonra ilhak ederek 82 y\u0131l s\u00f6m\u00fcrge olarak kullanan \u0130ngiltere(3) olmu\u015ftur.<\/p>\n<p>Rusya\u2019ya kar\u015f\u0131 Osmanl\u0131 Devleti\u2019ne yard\u0131m etme kar\u015f\u0131l\u0131\u011f\u0131nda 1878\u2019de K\u0131br\u0131s\u2019\u0131n sadece kullan\u0131m hakk\u0131n\u0131 elde eden ve Rusya i\u015fgal etti\u011fi yerlerden \u00e7\u0131k\u0131nca aday\u0131 Osmanl\u0131 Devleti\u2019ne geri vermeyi taahh\u00fct eden \u0130ngiltere s\u00f6z\u00fcnde durmad\u0131\u011f\u0131 gibi 1913 y\u0131l\u0131nda aday\u0131 ilhak etti\u011fini a\u00e7\u0131klam\u0131\u015f ve kurdu\u011fu s\u00f6m\u00fcrge y\u00f6netimiyle K\u0131br\u0131s\u2019\u0131 1960 y\u0131l\u0131na kadar idare etmi\u015ftir.<\/p>\n<p>K\u0131br\u0131s\u2019\u0131n Osmanl\u0131 d\u00f6nemindeki idare \u015fekli ile \u0130ngiliz s\u00f6m\u00fcrge y\u00f6netimindeki idare \u015feklini mukayese eden \u0130ngiliz tarih\u00e7i ve yazar William Hepworth Dixon ada halk\u0131n\u0131n Osmanl\u0131 d\u00f6neminde son derece geni\u015f \u00f6zg\u00fcrl\u00fcklere sahip oldu\u011funu, s\u00f6z konusu durumun \u0130ngiliz s\u00f6m\u00fcrge y\u00f6netiminde tamamen tersine d\u00f6nd\u00fc\u011f\u00fcn\u00fc ve ada halk\u0131n\u0131n y\u00f6netimden d\u0131\u015fland\u0131\u011f\u0131n\u0131 belirtmektedir.(4)<\/p>\n<p>\u0130ngiliz y\u00f6netiminin s\u00f6m\u00fcrge idaresinden memnun olmayan Rumlar 1925 y\u0131l\u0131ndan ba\u015flayarak K\u0131br\u0131s Cumhuriyeti\u2019nin kurulu\u015funa kadar ge\u00e7en s\u00fcre\u00e7te \u00f6nce \u0130ngiliz y\u00f6netimine, takip eden s\u00fcre\u00e7te ise adan\u0131n yerli halk\u0131 olan T\u00fcrklere kar\u015f\u0131 ter\u00f6r eylemlerine giri\u015fmi\u015flerdir. Yunanistan\u2019\u0131n ve K\u0131br\u0131sl\u0131 Rumlar\u0131n esas gayesi K\u0131br\u0131s\u2019\u0131 Yunanistan\u2019 a ba\u011flamak (ENOSIS) oldu\u011fundan Rumlar, \u0130ngiltere\u2019nin adadaki y\u00f6netim \u015feklinin d\u00fczeltilmesi i\u00e7in yeni bir anayasa haz\u0131rlanmas\u0131 teklifini de reddetmi\u015fler ve ENOSIS i\u00e7ermeyen hi\u00e7bir teklifi kabul etmeyeceklerini ilan etmi\u015flerdir.(5)<\/p>\n<p>Bu ortamda \u0130ngiltere, T\u00fcrkiye ve Yunanistan aras\u0131nda yap\u0131lan g\u00f6r\u00fc\u015fmelerden sonra imzalanan 1959 Z\u00fcrih ve pe\u015finden bu \u00fc\u00e7 \u00fclkeye K\u0131br\u0131sl\u0131 T\u00fcrklerle K\u0131br\u0131sl\u0131 Rumlar\u0131n temsilcilerinin de kat\u0131l\u0131m\u0131yla imzalanan 1960 Londra Antla\u015fmalar\u0131yla K\u0131br\u0131s Cumhuriyeti kurulmu\u015f ve 1960 y\u0131l\u0131nda haz\u0131rlanan K\u0131br\u0131s anayasas\u0131 T\u00fcrkiye, Yunanistan ve \u0130ngiltere\u2019nin garant\u00f6rl\u00fc\u011f\u00fc ile g\u00fcvence alt\u0131na al\u0131nm\u0131\u015ft\u0131r.<\/p>\n<p>Ancak Yunanistan\u2019\u0131n ve K\u0131br\u0131sl\u0131 Rumlar\u0131n as\u0131l hedefi birlikte ya\u015famak de\u011fil, T\u00fcrkleri adadan kovmak ve adaya tek ba\u015f\u0131na sahip olarak Yunanistan\u2019la birle\u015fmek oldu\u011fundan kurulu\u015fundan bir y\u0131l ge\u00e7meden K\u0131br\u0131s Devlet Ba\u015fkan\u0131 Makarios anayasay\u0131 de\u011fi\u015ftirerek T\u00fcrklerin hak ve yetkilerini elinden almaya kalkm\u0131\u015f ve T\u00fcrkiye\u2019nin anayasa de\u011fi\u015fikli\u011fini reddetmesi \u00fczerine adaya Yunanistan\u2019dan getirdi\u011fi 54.000 askere dayanarak ENOSIS\u2019i ger\u00e7ekle\u015ftirmeye te\u015febb\u00fcs etmi\u015ftir.(6)<\/p>\n<p>K\u0131br\u0131s\u2019\u0131n Yunanistan\u2019a ilhak\u0131n\u0131 sa\u011flamak \u00fczere adaya g\u00f6nderilen Albay Grivas\u2019\u0131n emrindeki EOKA ter\u00f6r \u00f6rg\u00fct\u00fc T\u00fcrklere kar\u015f\u0131 kitlesel eylemlere ba\u015flay\u0131nca TBMM T\u00fcrk ordusunun adaya m\u00fcdahalesi i\u00e7in yetki karar\u0131 \u00e7\u0131kartm\u0131\u015f, ancak 1974 y\u0131l\u0131ndaki Nickos Samson darbesine kadar ge\u00e7en s\u00fcre\u00e7te K\u0131br\u0131s\u2019ta Rum\/Yunan ikilisine kar\u015f\u0131 T\u00fcrk Hava Kuvvetlerinin ikaz u\u00e7u\u015flar\u0131 d\u0131\u015f\u0131nda herhangi bir harek\u00e2t icra edilmemi\u015ftir.<\/p>\n<p>Takip eden s\u00fcre\u00e7te Yunanistan\u2019da askeri darbe ya\u015fanm\u0131\u015f ve Cunta liderleri Yunanistan\u2019\u0131n y\u00f6netimine el koymu\u015ftur. K\u0131br\u0131s\u2019\u0131n bir an evvel Yunanistan\u2019a ba\u011flanmas\u0131n\u0131 isteyen cunta liderleri, Makarios\u2019un bu konudaki \u00e7abalar\u0131n\u0131 yetersiz buldu\u011fundan cunta liderlerinin ve aday\u0131 Yunanistan\u2019a ba\u011flamak \u00fczere g\u00f6revlendirdikleri Grivas\u2019\u0131n Makarios\u2019la aras\u0131 a\u00e7\u0131lm\u0131\u015ft\u0131r. Grivas\u2019\u0131n emrindeki EOKA B \u00f6rg\u00fct\u00fcn\u00fcn aday\u0131 bir an \u00f6nce Yunanistan\u2019a ilhak etmek \u00fczere Makarios\u2019a suikast giri\u015fiminde bulunmas\u0131n\u0131 m\u00fcteakip Makarios Yunan Cumhurba\u015fkan\u0131na bir mektup yazarak Rum Milli Muhaf\u0131z Ordusu (RMMO)\u2019nu e\u011fiten 650 Yunanl\u0131 subay\u0131n adadan \u00e7ekilmesini istemi\u015ftir.(7)<\/p>\n<p>Makarios\u2019un yazd\u0131\u011f\u0131 mektup cuntac\u0131lar\u0131n K\u0131br\u0131s Cumhurba\u015fkan\u0131 Makarios\u2019u bir darbeyle devirerek yerine Nickos Samson\u2019u getirme ve ENOSIS\u2019i ilan etme karar\u0131 almalar\u0131yla sonu\u00e7lanm\u0131\u015ft\u0131r.<\/p>\n<p>15 Temmuz 1974\u2019de Yunanl\u0131 subaylar\u0131n yapt\u0131\u011f\u0131 askeri darbe ve ENOSIS\u2019in ilan\u0131 \u00fczerine T\u00fcrkiye adan\u0131n Yunanistan\u2019a ilhak\u0131n\u0131 \u00f6nlemek ve adadaki T\u00fcrklerin can g\u00fcvenli\u011fini sa\u011flamak \u00fczere garant\u00f6rl\u00fck hakk\u0131n\u0131 kullanarak adaya m\u00fcdahale etmi\u015ftir. T\u00fcrk ordusu K\u0131br\u0131s\u2019\u0131n tamam\u0131n\u0131 alabilecek g\u00fc\u00e7te oldu\u011fu halde bu yap\u0131lmam\u0131\u015f ve adan\u0131n kuzeyinde T\u00fcrklerin yo\u011fun olarak ya\u015fad\u0131\u011f\u0131 %36\u2019l\u0131k bir toprak par\u00e7as\u0131 ele ge\u00e7irilerek T\u00fcrklerin Rum bask\u0131 ve katliam\u0131na maruz kalmadan ya\u015fayabilecekleri bir \u00f6zerk b\u00f6lge yarat\u0131lm\u0131\u015ft\u0131r. Takip eden s\u00fcre\u00e7te 13 \u015eubat 1975\u2019de K\u0131br\u0131s T\u00fcrk Federe Devleti (KTFD) ilan edilmi\u015ftir.<\/p>\n<p>Harek\u00e2t sonras\u0131nda Yunanistan\u2019daki ve K\u0131br\u0131s\u2019taki askeri cuntalar devrilmi\u015f, Rumlar\u0131n kendi aralar\u0131nda ba\u015flatt\u0131klar\u0131 i\u00e7 sava\u015f sona ermi\u015f ve Rumlar\u0131n ba\u015f\u0131na Spiros Kyprianou ge\u00e7mi\u015ftir. Ancak Kyprianou da ENOSIS taraftar\u0131 Makarios\u2019un izinden y\u00fcr\u00fcmeye devam etmi\u015ftir.(8)<\/p>\n<h2><strong>T\u00fcrk-Rum n\u00fcfus m\u00fcbadelesi, BM\u2019nin tarafgir tutumu ve KKTC\u2019nin ilan\u0131<\/strong><\/h2>\n<p>KTFD, kurulu\u015funu m\u00fcteakip 2 May\u0131s 1975 tarihli y\u00f6netmeli\u011fe dayanarak, i\u015f g\u00fcc\u00fc a\u00e7\u0131\u011f\u0131n\u0131 kapatmak i\u00e7in T\u00fcrkiye\u2019den k\u0131rk bin g\u00f6\u00e7men getirtmi\u015ftir. Daha sonra 2 A\u011fustos 1975 tarihinde yap\u0131lan anla\u015fmayla BM arac\u0131l\u0131\u011f\u0131yla g\u00fcneyde kalan T\u00fcrklerin KTFD b\u00f6lgesine, kuzeyde kalan Rumlar\u0131n ise GKRY b\u00f6lgesine g\u00f6nderilmesi esas\u0131na dayanan bir n\u00fcfus m\u00fcbadelesi yap\u0131lm\u0131\u015ft\u0131r. Bu m\u00fcbadeleyle g\u00fcneyde esir olarak tutulan T\u00fcrklerin KTFD topraklar\u0131na ge\u00e7mesi suretiyle K\u0131br\u0131sl\u0131 T\u00fcrkler tarihte ilk kez b\u00fct\u00fcn n\u00fcfuslar\u0131yla birlikte, s\u0131n\u0131rlar\u0131 belli olan bir b\u00f6lgede toplanm\u0131\u015f ve \u00f6zg\u00fcrl\u00fcklerine kavu\u015farak Rum sald\u0131r\u0131lar\u0131ndan korunma imk\u00e2n\u0131na sahip olmu\u015flard\u0131r.(9)<\/p>\n<p>1977-1983 y\u0131llar\u0131 aras\u0131nda KTDF ve GKRY temsilcileri aras\u0131nda g\u00f6r\u00fc\u015fmeler yap\u0131lm\u0131\u015f, ancak ENOS\u0130S hayalinden vazge\u00e7emeyen Rumlar\u0131n T\u00fcrkleri az\u0131nl\u0131k, kendilerini ise adan\u0131n tamam\u0131n\u0131n temsilcisi olarak g\u00f6rmeleri ve BM yetkililerinin Rum yanl\u0131s\u0131 tutumu nedeniyle g\u00f6r\u00fc\u015fmelerden bir sonu\u00e7 al\u0131namam\u0131\u015ft\u0131r.<\/p>\n<p>Rumlar\u0131n ve Yunanistan\u2019\u0131n K\u0131br\u0131s\u2019\u0131n tamam\u0131n\u0131 Yunanistan\u2019a ilhak etme ve K\u0131br\u0131s T\u00fcrk halk\u0131n\u0131 katliam yaparak adadan ka\u00e7\u0131rma, kalanlar\u0131 ise Rumlara az\u0131nl\u0131k olarak ba\u011flama politikalar\u0131n\u0131n sonucu olarak giri\u015ftikleri t\u00fcm katliamlara ve a\u011f\u0131r insan haklar\u0131 ihlallerine kar\u015f\u0131 gereken tepkiyi g\u00f6stermeyen BM, T\u00fcrkiye Cumhuriyeti\u2019nin adadaki soyda\u015flar\u0131n\u0131 korumak \u00fczere ba\u015flatt\u0131\u011f\u0131 K\u0131br\u0131s Bar\u0131\u015f Harek\u00e2t\u0131ndan sonra su\u00e7lu ile ma\u011fduru e\u015fit g\u00f6ren bir tutum i\u00e7ine girmi\u015ftir.<\/p>\n<p>Daha vahimi Z\u00fcrih ve Londra Antla\u015fmalar\u0131na ayk\u0131r\u0131 olarak Rum\/Yunan ikilisinin 1960 Anayasas\u0131n\u0131 ortadan kald\u0131rarak aday\u0131 Yunanistan\u2019a ba\u011flamak \u00fczere giri\u015fti\u011fi darbeye ra\u011fmen BM, Rum taraf\u0131n\u0131 adan\u0131n resmi temsilcisi olarak g\u00f6ren bir anlay\u0131\u015f\u0131n i\u00e7inde olmu\u015ftur.(10)<\/p>\n<p>Bu kapsamda BM Genel Kurulunda kabul edilen 13 May\u0131s 1983 tarih ve 37\/253 say\u0131l\u0131 kararda Rumlar\u0131n adan\u0131n tamam\u0131nda egemenlik hakk\u0131n\u0131n oldu\u011fu ve i\u015fgalci g\u00fc\u00e7 olarak nitelendirilen T\u00fcrk birliklerinin adadan \u00e7ekilmesi ve KTFD\u2019nin sona erdirilmesi gerekti\u011finin belirtilmesi \u00fczerine KTFD ve T\u00fcrkiye, bu karar\u0131 derhal reddetmi\u015f ve KTFD Meclisi, 17 Haziran 1983\u2019te* K\u0131br\u0131s T\u00fcrklerinin self-determinasyon hakk\u0131n\u0131n oldu\u011funu ilan etmi\u015ftir.(11)<\/p>\n<p>BM\u2019nin sald\u0131rgan taraf olan Rumlardan yana kararlar almas\u0131 Rum taraf\u0131n\u0131 cesaretlendirmi\u015f ve 1960-1963 y\u0131llar\u0131 aras\u0131nda Avrupa Konseyi\u2019nde K\u0131br\u0131s\u2019\u0131 temsilen iki Rum, bir T\u00fcrk temsilcisi bulunmas\u0131na ve Rumlar\u0131n anayasay\u0131 ask\u0131ya almas\u0131 nedeniyle s\u00f6z konusu temsiliyetin 1964 y\u0131l\u0131nda dondurulmu\u015f olmas\u0131na ra\u011fmen Rumlar 1983 y\u0131l\u0131nda K\u0131br\u0131s\u2019\u0131 sadece Rumlar\u0131n temsil etti\u011fini \u00f6ne s\u00fcrm\u00fc\u015f ve s\u00f6z konusu g\u00f6r\u00fc\u015f\u00fc Avrupa Konseyi (AK) de onaylam\u0131\u015ft\u0131r.(12)<\/p>\n<p>BM\u2019nin ve AK\u2019nin s\u00f6z konusu tarafgir tutumu ve kararlar\u0131 K\u0131br\u0131s T\u00fcrk halk\u0131n\u0131n, uluslararas\u0131 sayg\u0131n kurumlar\u0131n sayg\u0131nl\u0131klar\u0131yla ba\u011fda\u015fmayan \u015fekilde tarafgirlik i\u00e7inde olduklar\u0131 ger\u00e7e\u011fini g\u00f6rmelerine ve KKTC\u2019nin ilan\u0131ndan ba\u015fka \u00e7\u0131kar yol olmad\u0131\u011f\u0131n\u0131 anlamalar\u0131na vesile olmu\u015f ve 15 Kas\u0131m 1983\u2019te KKTC\u2019nin kurulu\u015fu ilan edilmi\u015ftir. Daha sonra 70 ki\u015filik Kurucu Meclis KKTC\u2019nin Anayasas\u0131n\u0131 haz\u0131rlayarak halkoyuna sunmu\u015f ve KKTC Anayasas\u0131 halk\u0131n %70,18\u2019inin oyuyla kabul edilmi\u015ftir.<\/p>\n<p>Kabul edilen Anayasan\u0131n Ba\u015flang\u0131\u00e7 B\u00f6l\u00fcm\u00fcnde yer alan a\u015fa\u011f\u0131daki ifadeler K\u0131br\u0131s T\u00fcrk halk\u0131n\u0131n ge\u00e7mi\u015ften g\u00fcn\u00fcm\u00fcze kadar ya\u015fad\u0131\u011f\u0131 olaylar\u0131 ve \u00e7\u00f6z\u00fcm yollar\u0131n\u0131 m\u00fckemmel \u015fekilde ifade etmektedir:<\/p>\n<p><em>\u201cTarihi boyunca ba\u011f\u0131ms\u0131z ya\u015fam\u0131\u015f, hak ve \u00f6zg\u00fcrl\u00fckleri i\u00e7in sava\u015f\u0131m vermi\u015f b\u00fcy\u00fck T\u00fcrk Ulusunun ayr\u0131lmaz bir par\u00e7as\u0131 bulunan; Rumlar\u0131n t\u00fcm uzla\u015fmaz tav\u0131rlar\u0131na ra\u011fmen AB, 1 May\u0131s 2004\u2019de, GKRY\u2019yi \u201cK\u0131br\u0131s Cumhuriyeti\u201d s\u0131fat\u0131yla, b\u00fct\u00fcn aday\u0131 temsilen AB\u2019ye \u00fcye yapm\u0131\u015ft\u0131r. AB\u2019ye \u00fcye yap\u0131lmas\u0131n\u0131 m\u00fcteakip GKRY ve arkas\u0131ndaki g\u00fc\u00e7 olan Yunanistan \u00fcyeli\u011fin sa\u011flad\u0131\u011f\u0131 siyasi g\u00fc\u00e7 ve veto haklar\u0131ndan yararlanarak T\u00fcrkiye ve KKTC\u2019ye kar\u015f\u0131 tutumlar\u0131n\u0131 sertle\u015ftirmi\u015fler ve AB \u00fcyeli\u011fini T\u00fcrkiye\u2019ye ve KKTC\u2019ye kar\u015f\u0131 koz olarak kullanmaya ba\u015flam\u0131\u015flard\u0131r.<\/p>\n<p>K\u0131br\u0131s\u2019\u0131n sadece Rum kesimini \u00fcye yapabilen AB ise, K\u0131br\u0131sl\u0131 T\u00fcrklerin ya\u015fad\u0131\u011f\u0131 topraklar\u0131 da AB topra\u011f\u0131 haline getirerek K\u0131br\u0131s\u2019\u0131n tamam\u0131na sahip olabilmek i\u00e7in BM\u2019yi de kullanarak T\u00fcrkiye\u2019ye ve KKTC\u2019ye dayatmalarda bulunmakta ve su\u00e7lu taraf\u0131 kay\u0131r\u0131rken ma\u011fdur taraf\u0131 haks\u0131z ambargo uygulamalar\u0131yla cezaland\u0131rmakta ve hukuka ayk\u0131r\u0131 uygulamalar\u0131n\u0131 kabule zorlamaktad\u0131r.<\/p>\n<p>Bu kapsamda BM, AB ve ABD taraf\u0131ndan T\u00fcrkiye\u2019ye ve KKTC\u2019ye dayat\u0131lan en \u00f6nemli belge Annan Plan\u0131d\u0131r. Bu yap\u0131lmadan AB \u00fcyeli\u011fi bizim i\u00e7in \u00e7ekici olamazd\u0131.<\/em><\/p>\n<p><em>Bu yasal hakk\u0131m\u0131z\u0131 kabul etmek istemediler. Bunca y\u0131ll\u0131k m\u00fccadelemiz b\u00f6yle bir ihtimali \u00f6nleyecek tedbirler bulmak i\u00e7indi. KKTC\u2019nin kurulu\u015fu, e\u015fit egemenlikte \u0131srar bunun i\u00e7indi. Annan Plan\u0131 bunlar\u0131 al\u0131p g\u00f6t\u00fcrmektedir.<\/em><\/p>\n<p><em>Bu plan mal-m\u00fclk meselelerini, her an patlayacak binlerce saatli bomba halinde i\u00e7imizde b\u0131rak\u0131yor. Taraflar aras\u0131nda halledilmesi gereken bir sorunu, 30 y\u0131ldan sonra, K\u0131br\u0131s\u2019ta 1963-1974 aras\u0131nda ya\u015fanan olaylar\u0131, T\u00fcrklere yap\u0131lanlar\u0131 unutarak; iki kesimlili\u011fin 1975, 1977 ve 1979 anla\u015fmalar\u0131 ile kal\u0131c\u0131 bir bar\u0131\u015f i\u00e7in kabul edilmi\u015f bir form\u00fcl oldu\u011funu kaale almayarak bireyler aras\u0131ndaki bir al-ver davas\u0131 haline getiriyor. K\u0131br\u0131s\u2019\u0131n t\u00fcm\u00fcn\u00fcn derhal AB\u2019ye girmesindeki \u0131srar bu nedene dayanmaktad\u0131r. AB bu konuda bir ara\u00e7 olarak kullan\u0131lmaktad\u0131r.<\/em><\/p>\n<p><em>AB, Rumlarla anla\u015fm\u0131\u015f olsak bile ihtiyac\u0131m\u0131z olan g\u00fcvenceleri i\u00e7erecek olan bu anla\u015fmaya Birincil Hukuk Stat\u00fcs\u00fc vermiyor. Aldat\u0131c\u0131 form\u00fcller \u00f6neriyor. B\u00f6ylelikle yerli ve yabanc\u0131 hukuk\u00e7ular\u0131n deyimiyle anla\u015fman\u0131n, yaz\u0131ld\u0131\u011f\u0131 k\u00e2\u011f\u0131t kadar bile k\u0131ymeti kalm\u0131yor.
