Mara\u015f\u2019\u0131n a\u00e7\u0131lmas\u0131, K\u0131br\u0131s meselesinde \u00f6nemli bir de\u011fi\u015fimin, farkl\u0131 bir yakla\u015f\u0131m\u0131n simgesi olmaya aday bir ad\u0131m. Peki, Mara\u015f\u2019\u0131n a\u00e7\u0131lmas\u0131 hayata ge\u00e7irilebilecek bir proje mi? Yoksa envanter tespiti a\u015famas\u0131nda m\u0131 kal\u0131r? Kar\u015f\u0131la\u015f\u0131lacak hukuki sorunlar neler olacak ve KKTC bunlara haz\u0131rl\u0131kl\u0131 m\u0131? Mara\u015f\u2019\u0131n asl\u0131nda vak\u0131f m\u00fclk\u00fc oldu\u011fu iddialar\u0131n\u0131n dayana\u011f\u0131 nedir ve arazi Vak\u0131flar\u2019a aitse \u00fczerine yap\u0131lan binalar\u0131n durumu ne olacak?<\/p>\n<p>Mara\u015f\u2019\u0131n a\u00e7\u0131lmas\u0131 \u00f6ncelikle \u015fehrin askeri b\u00f6lge olmaktan \u00e7\u0131kmas\u0131, sivil hayat\u0131n ba\u015flamas\u0131 anlam\u0131na gelir. Keza Mara\u015f, BM Ye\u015fil Hatt\u0131n\u0131n tampon b\u00f6lgesi olarak kabul edilmektedir. Kuzey K\u0131br\u0131s&#8217;\u0131n Gazima\u011fusa \u015fehrine ba\u011fl\u0131 olan Mara\u015f, 1974&#8217;te BMGK&#8217;nin ald\u0131\u011f\u0131 karar uyar\u0131nca hem yerle\u015fime hem de isk\u00e2na kapat\u0131lm\u0131\u015ft\u0131. \u0130kinci olarak bir anla\u015fma ya da g\u00fcven artt\u0131r\u0131c\u0131 \u00f6nlem kapsam\u0131nda Mara\u015f\u2019\u0131n Rum Y\u00f6netimi\u2019ne verilmeyece\u011fi anlam\u0131na gelir. \u00dc\u00e7\u00fcnc\u00fc olarak BM G\u00fcvenlik Konseyi\u2019nin ilgili karar\u0131 aleyhine ama A\u0130HM yakla\u015f\u0131m\u0131na uygun ve Mara\u015f\u2019taki m\u00fclk sahipleri yarar\u0131na hareket edildi\u011fi anlam\u0131na gelir. Mara\u015f\u2019la ilgili A\u0130HM\u2019e ta\u015f\u0131nmak istenen 274 ba\u015fvuru oldu\u011funu not d\u00fc\u015felim. D\u00f6rd\u00fcnc\u00fc olarak ise KKTC\u2019nin Rum Y\u00f6netimi\u2019nin beklenti ve itirazlar\u0131ndan tamamen ba\u011f\u0131ms\u0131z hareket etti\u011fi anlam\u0131na gelir. Bu da Mara\u015f\u2019\u0131n gelece\u011fi konusundaki tasarruflarda KKTC\u2019nin karar verici oldu\u011fu; devlet kararl\u0131l\u0131\u011f\u0131 g\u00f6sterildi\u011fi anlam\u0131na gelir. Anla\u015f\u0131lan KKTC H\u00fck\u00fcmeti stat\u00fckonun terk edilmesi konusunda \u0131srarc\u0131 ve bunun i\u00e7in bir metot da geli\u015ftirmi\u015f. S\u00fcre\u00e7 de g\u00f6sterdi ki Mara\u015f, Rumlar\u0131n -do\u011falgaz gelirlerini payla\u015fmak da dahil- bir \u015fekilde m\u00fczakere masas\u0131na \u00e7ekilebilmesi i\u00e7in bir bl\u00f6f olarak ortaya at\u0131lmam\u0131\u015f.<\/p>\n<p>Rum Y\u00f6netimi (GKRY), Mara\u015f\u2019\u0131n a\u00e7\u0131lmas\u0131n\u0131n \u00f6n\u00fcne ge\u00e7mek i\u00e7in kimi giri\u015fimlerde bulundu. Yeni bir m\u00fczakere s\u00fcreci ba\u015flatmak ilk giri\u015fimdi. Rum lider Anastasiadis, federasyon zemininde m\u00fczakere y\u00fcr\u00fct\u00fclmesini anlams\u0131z buldu\u011funu Crans Montana zirvesinin bitiminde ifade etmi\u015f; 2018\u2019de de T\u00fcrklerin yerel y\u00f6netimlerdeki yetkilerinin artt\u0131r\u0131laca\u011f\u0131 ama merkezi devletteki y\u00f6netimde etkisizle\u015ftirilece\u011fi (desantralizasyon) bir m\u00fczakere zemini \u00f6nermi\u015fti. Mara\u015f\u2019\u0131n a\u00e7\u0131lmas\u0131 karar\u0131 ve Do\u011fu Akdeniz\u2019de T\u00fcrkiye\u2019nin kendi k\u0131tasahanl\u0131\u011f\u0131 ve KKTC\u2019nin yetkilendirmesiyle KKTC\u2019nin deniz b\u00f6lgelerinde ger\u00e7ekle\u015ftirdi\u011fi sondaj faaliyetleri ise Anastasiadis \u00fczerindeki bask\u0131y\u0131 artt\u0131rd\u0131. Rum muhalifler ama \u00f6zellikle AKEL, derhal bir m\u00fczakere masas\u0131n\u0131n kurulmas\u0131n\u0131 istiyordu. Anastasiadis, yeni s\u00fcrecin ba\u015flayabilmesinin \u00f6n ko\u015fulu olarak Mara\u015f\u2019\u0131n a\u00e7\u0131lmas\u0131 giri\u015fimlerinin iptal edilmesi ve Do\u011fu Akdeniz\u2019deki sondaj faaliyetlerinin sonland\u0131r\u0131lmas\u0131n\u0131 istedi. Rum taraf\u0131n\u0131n \u201creferans \u015fartlar\u0131\u201d, KKTC Cumhurba\u015fkan\u0131 Ak\u0131nc\u0131 taraf\u0131ndan reddedildi. Ak\u0131nc\u0131\u2019n\u0131n da hidrokarbon konusunda ortak komite kurulmas\u0131 \u00f6nerisi reddedildi. Belirtilmeli ki referans \u015fartlarda uzla\u015f\u0131 sa\u011flanamad\u0131\u011f\u0131n\u0131n ilan edilmesine ra\u011fmen BM Genel Sekreteri, New York\u2019ta taraflarla bir araya gelerek m\u00fczakere s\u00fcreci ba\u015flatma giri\u015fimini s\u00fcrd\u00fcrecek. Rum Y\u00f6netimi\u2019nin Mara\u015f\u2019\u0131n a\u00e7\u0131lmas\u0131n\u0131 \u00f6nleyebilmek amac\u0131yla konuyu BM Genel Kurulu\u2019na ta\u015f\u0131ma haz\u0131rl\u0131\u011f\u0131 da ikinci \u00f6nemli giri\u015fimi olacak. Burada GKRY, BM G\u00fcvenlik Konseyi\u2019nin (BMGK) 550 say\u0131l\u0131 karar\u0131na dayanacakt\u0131r.<\/p>\n<h2><strong>Engel: 550 say\u0131l\u0131 g\u00fcvenlik konseyi karar\u0131<\/strong><\/h2>\n<p>Mara\u015f\u2019\u0131n a\u00e7\u0131lmas\u0131 giri\u015fiminin \u00f6n\u00fcndeki en b\u00fcy\u00fck engel de be\u015finci maddesinde \u201c<em>Mara\u015f\u2019\u0131n herhangi bir b\u00f6l\u00fcm\u00fcne kendi sakini d\u0131\u015f\u0131ndaki insanlar\u0131n yerle\u015ftirilmesi \u00e7abalar\u0131n\u0131 kabul edilmez olarak niteler ve bu b\u00f6lgenin Birle\u015fmi\u015f Milletler y\u00f6netimine devredilmesi \u00e7a\u011fr\u0131s\u0131nda bulunur<\/em>\u201d diyen BMGK\u2019nin<a href=\"#_ftn1\" name=\"_ftnref1\">[1]<\/a> 11 May\u0131s 1984\u2019te ald\u0131\u011f\u0131 550 say\u0131l\u0131 karard\u0131r. Hemen belirtilmeli ki KKTC\u2019nin projesi zaten Mara\u015f\u2019\u0131n 74 \u00f6ncesi sakinlerine yap\u0131lacak \u00e7a\u011fr\u0131y\u0131 hedefliyor. \u00dcstelik karar kentin sakinlerinden bahsediyor ve bu o d\u00f6nemin kirac\u0131lar\u0131n\u0131 da kapsayan bir s\u00f6zc\u00fckt\u00fcr. Bu anlamda 550 say\u0131l\u0131 kararla \u00e7eli\u015fen bir yakla\u015f\u0131m yok. \u00d6te yandan 550 say\u0131l\u0131 karar\u0131n ba\u011flay\u0131c\u0131l\u0131\u011f\u0131 tart\u0131\u015fmal\u0131d\u0131r. Nitekim ayn\u0131 kararda KKTC\u2019nin ilan\u0131n\u0131n geri al\u0131nmas\u0131 da istenmi\u015fti ve \u201c<em>T\u00fcrkiye ve K\u0131br\u0131s T\u00fcrk liderli\u011fi aras\u0131ndaki kar\u015f\u0131l\u0131kl\u0131 b\u00fcy\u00fckel\u00e7i atanmas\u0131 gibi ayr\u0131l\u0131k\u00e7\u0131 hareketleri k\u0131nar<\/em>\u201d ifadesi de bulunuyordu. Ba\u011f\u0131ms\u0131zl\u0131\u011f\u0131n\u0131n 36. y\u0131l\u0131 kutlayan KKTC\u2019nin 550 say\u0131l\u0131 karar\u0131 Mara\u015f\u2019\u0131n a\u00e7\u0131lmas\u0131 \u00f6n\u00fcnde engel olarak g\u00f6rmesi mant\u0131kl\u0131 bir beklenti olmayacakt\u0131r. Kald\u0131 ki gerek 550 say\u0131l\u0131 gerekse KKTC\u2019yi yasa d\u0131\u015f\u0131 kabul eden ve tan\u0131nmamas\u0131 \u00e7a\u011fr\u0131s\u0131nda bulunan 1983\/541 say\u0131l\u0131 BMGK kararlar\u0131, siyasi ba\u011flay\u0131c\u0131l\u0131\u011f\u0131 olmayan tavsiye nitelikli kararlard\u0131r. Kararlar KKTC\u2019nin ba\u011f\u0131ms\u0131z bir devlet olma niteli\u011fini ortadan kald\u0131rmazlar. Al\u0131nd\u0131klar\u0131 d\u00f6nemde dahi usul ve esasa ayk\u0131r\u0131 nitelikte olduklar\u0131 i\u00e7in ele\u015ftirilmi\u015f, G\u00fcvenlik Konseyi\u2019nin yarg\u0131 organ\u0131 gibi hareket etmekle yetki a\u015f\u0131m\u0131nda bulundu\u011fu ifade edilmi\u015fti.<a href=\"#_ftn2\" name=\"_ftnref2\">[2]<\/a> Keza bu iki karar \u201c<em>iki toplumu da temsil eden me\u015fru bir \u2018K\u0131br\u0131s H\u00fck\u00fcmeti\u2019nin\u2019 varl\u0131\u011f\u0131n\u0131 s\u00fcrd\u00fcrd\u00fc\u011f\u00fcn\u00fc<\/em>\u201d s\u00f6yleyen 1964\/186 say\u0131l\u0131 bir ba\u015fka hatal\u0131 karara dayan\u0131rlar. K\u0131br\u0131sl\u0131 T\u00fcrklerin haklar\u0131n\u0131 savunmas\u0131z k\u0131lan da zaten bu kararlard\u0131r.<\/p>\n<p>Di\u011fer taraftan \u201ciki kesimlilik\u201d, \u201csiyasi e\u015fitlik\u201d gibi K\u0131br\u0131s m\u00fczakereleri i\u00e7in BM\u2019nin ilkesi haline gelmi\u015f pek \u00e7ok konuda ciddi sapmalar ya\u015fand\u0131. 1990\/649 say\u0131l\u0131 BMGK karar\u0131ndaki \u201ctoplumlar\u0131n siyasi e\u015fitli\u011fi\u201d ilkesi<a href=\"#_ftn3\" name=\"_ftnref3\">[3]<\/a> Cenevre Zirvesi\u2019nde korunamad\u0131. De\u011fi\u015fen konjonkt\u00fcr nas\u0131l ki \u201ciki kesimlilik\u201d ilkesinin i\u015fletilmesine izin vermiyor Mara\u015f hakk\u0131ndaki ilgili karar da yeni g\u00fcn\u00fcn konjonkt\u00fcr\u00fc \u00e7er\u00e7evesinde de\u011ferlendirilmelidir.<\/p>\n<p>Asl\u0131nda hukuk\u00e7u olan KKTC D\u0131\u015fi\u015fleri Bakan\u0131 Kudret \u00d6zersay\u2019\u0131n Mara\u015f\u2019ta BM kararlar\u0131na g\u00f6re hareket etme yakla\u015f\u0131m\u0131n\u0131n Rum taraf\u0131n\u0131n tezi oldu\u011funu vurgulamas\u0131,<a href=\"#_ftn4\" name=\"_ftnref4\">[4]<\/a> Mara\u015f\u2019ta at\u0131lacak ad\u0131mlarda BM yetkililerini muhatap almad\u0131klar\u0131n\u0131; Mara\u015f\u2019ta yetki icra etme ve buraya ili\u015fkin tasarruf hakk\u0131n\u0131n tamamen KKTC H\u00fck\u00fcmeti\u2019nin inisiyatifinde oldu\u011funu s\u00f6ylemesi, KKTC\u2019nin konuya bak\u0131\u015f\u0131n\u0131 \u00f6zetler. Belli ki 550 say\u0131l\u0131 karar, hukuki bir engel olarak g\u00f6r\u00fclmemektedir ya da a\u015f\u0131lacak form\u00fcl \u00fcretilmi\u015ftir. Nitekim \u201cMara\u015f\u2019\u0131n sakinleri\u201d ifadesi, karar\u0131n lafzi yorumuna uygundur, ayk\u0131r\u0131l\u0131k s\u00f6z konusu de\u011fildir. \u00d6zersay, Rum taraf\u0131n\u0131n da bu s\u00fcrece \u00f6yle ya da b\u00f6yle dahil edilmeyece\u011fini vurguluyor. Ne yap\u0131lacaksa KKTC mevzuat\u0131 i\u00e7inde yap\u0131laca\u011f\u0131n\u0131 da s\u00f6yl\u00fcyor.<a href=\"#_ftn5\" name=\"_ftnref5\">[5]<\/a> Asl\u0131nda ekonomist olan KKTC Ba\u015fbakan\u0131 Ersin Tatar\u2019\u0131n, \u201c<em>Teli kald\u0131rd\u0131\u011f\u0131n\u0131z anda, plajda birka\u00e7 oteli a\u00e7ma durumunda Mara\u015f kendili\u011finden a\u00e7\u0131lacak ve ekonomimize g\u00fc\u00e7 verecek. \u00c7al\u0131\u015fmalar\u0131n \u00e7ok uzun s\u00fcrece\u011fini d\u00fc\u015f\u00fcnm\u00fcyorum. B\u00fcy\u00fck sermaye gruplar\u0131 bizimle isti\u015fare ediyor, bir tak\u0131m \u00f6n de\u011ferlendirmeler \u015fimdiden yap\u0131l\u0131yor. Mara\u015f\u2019\u0131n kendi kendini finanse edebilece\u011fi de bir ger\u00e7ektir<\/em>\u2026 <em>Ba\u015f edemeyece\u011fimiz b\u00fcy\u00fckl\u00fckte de de\u011fil.<\/em>\u201d<a href=\"#_ftn6\" name=\"_ftnref6\">[6]<\/a> s\u00f6zleri de KKTC\u2019nin salt envanter \u00e7al\u0131\u015fmas\u0131yla yetinmedi\u011fini, a\u00e7\u0131lmas\u0131 sonras\u0131 i\u00e7in de \u00e7al\u0131\u015fma y\u00fcr\u00fct\u00fcld\u00fc\u011f\u00fcn\u00fc d\u00fc\u015f\u00fcnd\u00fcr\u00fcyor. Rum bas\u0131n\u0131nda yer alan Rus ve \u00c7inli yat\u0131r\u0131mc\u0131lar\u0131n Kapal\u0131 Mara\u015f&#8217;ta m\u00fclk\u00fc olan Rumlar\u0131 m\u00fclklerini satmas\u0131 i\u00e7in ikna etmeye \u00e7al\u0131\u015ft\u0131\u011f\u0131 haberleri de tek haz\u0131rl\u0131k yapan\u0131n KKTC olmad\u0131\u011f\u0131n\u0131 g\u00f6stermektedir.<\/p>\n<h2><strong>Neden \u015fimdi? <\/strong><\/h2>\n<p>Rum Y\u00f6netimi, \u00e7\u00f6z\u00fcm durumunda zaten teslim alaca\u011f\u0131na inand\u0131\u011f\u0131 Mara\u015f\u2019\u0131n iadesini g\u00fcven artt\u0131r\u0131c\u0131 \u00f6nlemler paketi kapsam\u0131na almaya \u00e7al\u0131\u015fm\u0131\u015ft\u0131.<a href=\"#_ftn7\" name=\"_ftnref7\">[7]<\/a> Garant\u00f6rl\u00fck Anla\u015fmas\u0131\u2019n\u0131n iptali ve T\u00fcrk askerinin \u00e7ekilmesini g\u00f6r\u00fc\u015fmelerin \u00f6n \u015fart\u0131 yapma iste\u011finin arkas\u0131ndaki niyet Mara\u015f konusunda da ge\u00e7erli. M\u00fczakereler boyunca ald\u0131\u011f\u0131 her tavizi kazan\u0131m haline getiren ama verdi\u011fi tavizi bir sonraki g\u00f6r\u00fc\u015fmede yeni bir taviz almak i\u00e7in pazarl\u0131k konusu yapan Rum zihniyeti, K\u0131br\u0131s T\u00fcrk\u00fcn\u00fcn \u00e7\u00f6z\u00fclmesini kolayla\u015ft\u0131rmak istiyor. T\u00fcrk taraf\u0131 ise Mara\u015f\u2019\u0131n iadesinin g\u00fcven artt\u0131r\u0131c\u0131 \u00f6nlemler \u00e7er\u00e7evesinde de\u011ferlendirmenin ko\u015fulu olarak Ma\u011fusa Liman\u0131 ve Ercan Havaliman\u0131\u2019n\u0131n tan\u0131nmas\u0131 \u015fart\u0131n\u0131 ko\u015fmu\u015ftu. Vermeden almak isteyen Rum taraf\u0131 reddedince de Mara\u015f kapsam d\u0131\u015f\u0131 kalm\u0131\u015ft\u0131.<\/p>\n<p>Mara\u015f\u2019\u0131n g\u00f6r\u00fc\u015fmelerde yer al\u0131\u015f\u0131n\u0131n ge\u00e7mi\u015fi bu \u015fekilde. Ama Mara\u015f\u2019\u0131n a\u00e7\u0131lmas\u0131 karar\u0131n\u0131n g\u00fcndeme gelmesi, KKTC\u2019nin bu \u201cmasada kal\u201d oyununu s\u00fcrd\u00fcrmek istememesi ile ilgili. M\u00fczakereler bir ilerleme sa\u011flamad\u0131\u011f\u0131 gibi her kurulan masa, Rum taraf\u0131n\u0131n y\u00f6netimi, egemenli\u011fi yani ortak devletin idaresini T\u00fcrklerle payla\u015fmak istemedi\u011fini vurgulad\u0131\u011f\u0131 bir s\u00fcre\u00e7 halini ald\u0131. Asl\u0131nda Annan Plan\u0131 iki taraf\u0131n m\u00fczakerelerle varabilece\u011fi son noktayd\u0131. \u00c7\u00fcnk\u00fc referandum son a\u015famad\u0131r. Referandum neticesi, konuyu sonsuza dek kapat\u0131r. Ama ayn\u0131 de\u011ferlere inanan Mehmet Ali Talat- Dimitris Hristofias ikilisinin m\u00fczakere yapmas\u0131, d\u0131\u015far\u0131dan dayat\u0131ld\u0131. En son Mustafa Ak\u0131nc\u0131-Nikos Anastasiadis ikilisinin y\u00fcr\u00fctt\u00fc\u011f\u00fc m\u00fczakere s\u00fcreci de \u00e7\u00f6k\u00fcnce masada oyalanmay\u0131 durdurma hamlesinin de \u00f6n\u00fc a\u00e7\u0131lm\u0131\u015f oldu. Mara\u015f bu hamlenin en a\u00e7\u0131k sembol\u00fcd\u00fcr. K\u0131br\u0131s T\u00fcrk Halk\u0131n\u0131n Rum Halk\u0131n\u0131nkine paralel \u201cEgemen E\u015fitli\u011fi\u201d ve self- determinasyon hakk\u0131, -evveliyat\u0131 da olmakla birlikte- 19 Aral\u0131k 1956\u2019da \u0130ngiltere D\u0131\u015fi\u015fleri Bakan\u0131 Sir Alan Lennox Boyd taraf\u0131ndan Enosise kar\u015f\u0131, \u0130ngiliz Parlamentosunda zab\u0131tlara tescil ettirilmi\u015fti. KKTC bu temel hakk\u0131 \u00fczerinde y\u00fcr\u00fcmeye kararl\u0131. Ada\u2019daki askeri \u00fcsleri g\u00fcndeme getirdiklerinde Rumlara \u201cD\u00f6n\u00fcp de kurulu\u015f anla\u015fmalar\u0131n\u0131 okuyun\u201d diyen \u0130ngiliz mant\u0131\u011f\u0131n\u0131n T\u00fcrk halk\u0131n\u0131n egemen e\u015fitli\u011fi ve self determinasyon hakk\u0131 konusunda da ayn\u0131 tutumu sergilemesini beklemek yerinde olacakt\u0131r. Arazii Mevkufe ve icaretein Mevkufe t\u00fcr\u00fc vak\u0131f m\u00fclklerin kullan\u0131m hakk\u0131n\u0131, 10 y\u0131l ve daha fazla kulland\u0131\u011f\u0131n\u0131 ispat edenlerin ismine devrediyordu.<a href=\"#_ftn8\" name=\"_ftnref8\">[8]<\/a> \u0130\u015fte Mara\u015f\u2019\u0131n Vak\u0131f mal\u0131 oldu\u011fu biliniyordu ancak bunun \u0130ngiliz tapu sicilinde g\u00f6sterilip g\u00f6sterilmedi\u011fi bilinmiyordu; Rumlara yap\u0131lan devirlerin 1944 yasas\u0131 kapsam\u0131nda olup olmad\u0131\u011f\u0131 bilinmiyordu. Tapu Sicilleri \u0130ngiliz Y\u00f6netimi\u2019nin elindeydi; 1960-63 d\u00f6neminde ise Rumlar\u0131n elindeydi, T\u00fcrkler ise 1974\u2019e dek hayatta kalma m\u00fccadelesi vermekle me\u015fguld\u00fc. 1992\u2019de terk edilmi\u015f bir otelin bodrum kat\u0131nda tapular bulundu. Lala Mustafa Pa\u015fa mazbut; Abdullah Pa\u015fa Vakf\u0131 ise m\u00fclhak vak\u0131f olarak tapuya i\u015flenmi\u015fti. Mazbut ve m\u00fclhak vak\u0131f t\u00fcr\u00fcndeki vak\u0131flarsa zaten hi\u00e7bir zaman 14\/1944 say\u0131l\u0131 Yasa\u2019n\u0131n kapsam\u0131nda tutulmam\u0131\u015ft\u0131. \u0130ki husus var: (1) Bu iki vak\u0131f, \u0130ngiliz tapu sisteminde de tapuda kay\u0131tl\u0131yd\u0131 ve (2) vak\u0131f t\u00fcrleri itibariyle zaman a\u015f\u0131m\u0131 yoluyla 14\/1944 yasas\u0131na g\u00f6re 10 y\u0131l kullanana devredilen vak\u0131flardan de\u011fillerdi. M\u00fclk\u00fcn bulundu\u011fu yer mahkemesi olan Magusa Kaza Mahkemesi\u2019ne gidildi.<\/p>\n<p>Tapu belgelerini inceleyen Ma\u011fusa Kaza Mahkemesi, 28 Ocak 2002\u2019de Lala Mustafa Pa\u015fa Vakf\u0131na ait m\u00fclk davas\u0131n\u0131, 27 Aral\u0131k 2005\u2019te de (271\/2000 say\u0131l\u0131) Abdullah Pa\u015fa Vakf\u0131na ait m\u00fclk davas\u0131n\u0131 neticelendirip gasp edilen mallar\u0131n bu Vak\u0131flara ait oldu\u011funa ili\u015fkin tespit karar\u0131 ald\u0131. Kararlar tapu devir i\u015flemlerinin ge\u00e7ersizli\u011fini vurgular. Yani \u0130ngiliz d\u00f6neminde Vak\u0131f Mallar\u0131 usuls\u00fcz \u015fekilde Rumlar\u0131n \u00fczerine ge\u00e7irilmi\u015fti. Bir k\u0131sm\u0131n\u0131n \u00fczerine miras yoluyla, baz\u0131lar\u0131na istibdal, baz\u0131lar\u0131na da \u201chediye\u201d kayd\u0131 d\u00fc\u015f\u00fclerek Rumlara devredilmi\u015ftir. Mahkeme, uluslararas\u0131 bir mahkeme gibi hareket etti. Yapt\u0131\u011f\u0131 sadece tapu belgelerinin sahihli\u011fini tartmak de\u011fildi. 1571\u2019den beri y\u00fcr\u00fcrl\u00fckte olan Ahkam-\u00fcl Evkaf prensipleri, vak\u0131flara ili\u015fkin i\u00e7tihat de\u011fildi tek bak\u0131lan. Davan\u0131n avukatlar\u0131ndan Av. Ergin Ulunay\u2019\u0131n ifadesine g\u00f6re \u0130ngiliz Y\u00f6netimi ve K\u0131br\u0131s Cumhuriyeti d\u00f6neminde<a href=\"#_ftn9\" name=\"_ftnref9\">[9]<\/a> \u00e7\u0131kar\u0131lan vak\u0131flar\u0131 ve m\u00fclkiyeti ilgilendiren t\u00fcm kanunlar, y\u00f6netmelikler incelendi. Bahsi ge\u00e7en el de\u011fi\u015ftirmelerin \u0130ngiliz hukuk sisteminde yeri olup olmad\u0131\u011f\u0131, yani \u0130ngiliz hukuk sistemine uygunlu\u011fu incelendi.<\/p>\n<p>2006\u2019da kurulan Ta\u015f\u0131nmaz Mal Komisyonu da (TMK), Mara\u015f ile ilgili ba\u015fvurular\u0131 s\u00fcresiz ertelemi\u015f ve bu davalarda \u2018Vak\u0131flar ve Dini\u015fleri de taraft\u0131r\u2019 h\u00fckm\u00fcn\u00fc vermi\u015fti. Aral\u0131k 2016\u2019da Y\u00fcksek \u0130dare Mahkemesi ald\u0131\u011f\u0131 kararla Ma\u011fusa Kaza Mahkemesinin Kapal\u0131 Mara\u015f\u2019\u0131n Vak\u0131f Mal\u0131 oldu\u011funa dair karar\u0131n\u0131 onaylad\u0131 ve tescil etti. K\u0131sacas\u0131 Mara\u015f\u2019\u0131n a\u00e7\u0131lmas\u0131, sakinlerinin belediye hizmetleri, vergileri, yasalar\u0131, g\u00fcvenli\u011fi ile bir b\u00fct\u00fcn olarak KKTC devleti \u00e7at\u0131s\u0131 alt\u0131na gelmesidir ama ayn\u0131 zamanda \u00e7ok y\u00fckl\u00fc yepyeni bir dosyan\u0131n da a\u00e7\u0131lmas\u0131 anlam\u0131na gelir.<\/p>\n<p>KKTC H\u00fck\u00fcmeti\u2019nin plan\u0131, tapularda Mara\u015f\u2019\u0131n as\u0131l sahibi g\u00f6r\u00fcnen, Vak\u0131f \u0130daresi\u2019ne Mara\u015f\u2019\u0131 teslim etmek de\u011fil. Ama bahsi ge\u00e7en vak\u0131f m\u00fclklerinin m\u00fctevellisi olan K\u0131br\u0131s Vak\u0131flar \u00d6rg\u00fct\u00fc de bir taraft\u0131r, arazi \u00fczerinde hak iddias\u0131nda bulunabilecektir. Mahkeme \u00f6n\u00fcne geldi\u011finde ise muhtemelen arazi \u00fczerine otel, konut veya benzeri bina yapanlar\u0131n haklar\u0131 ayr\u0131, arazinin sahipli\u011fi ayr\u0131 ele al\u0131nacakt\u0131r. Vak\u0131flar \u0130daresi, bu a\u015famada arazi kira bedeli alarak mutasarr\u0131f hakk\u0131 sahiplerinin kullan\u0131m\u0131n\u0131 m\u00fcmk\u00fcn k\u0131lmak niyetinde oldu\u011funu a\u00e7\u0131kl\u0131yor. Belirtmek gerekir ki Vak\u0131flar \u0130daresi, ellerindeki belge ve haz\u0131rl\u0131kla H\u00fck\u00fcmetin plan\u0131 haricinde devreye girdi.<\/p>\n<p>Bahsetti\u011fimiz b\u00fcy\u00fck bir dosyad\u0131r \u00e7\u00fcnk\u00fc A\u0130HM, Arestis isimli Rum kad\u0131n\u0131n, elinde orijinal bir tapu kayd\u0131 ya da belgesi olmaks\u0131z\u0131n Mara\u015f&#8217;taki m\u00fclk\u00fcn\u00fc T\u00fcrkiye&#8217;nin asker\u00ee m\u00fcdahalesi nedeniyle kullanamad\u0131\u011f\u0131 gerek\u00e7esiyle 1998\u2019de a\u00e7t\u0131\u011f\u0131 dava ile ilgili olarak 22 Aral\u0131k 2005\u2019te T\u00fcrkiye\u2019yi su\u00e7lu buldu\u011fu karar\u0131n\u0131 a\u00e7\u0131klam\u0131\u015f; 7 Aral\u0131k 2006 karar\u0131nda ise 885 bin euro tazminat \u00f6demeye mahkum etmi\u015fti. Bu m\u00fclk Abdullah Pa\u015fa Vakf\u0131\u2019na aitti ve belgeleri T\u00fcrk taraf\u0131n\u0131n elindeydi ama A\u0130HM\u2019e sunulmam\u0131\u015ft\u0131. T\u00fcrklere, delil teslim s\u00fcresi dolmu\u015ftu diye a\u00e7\u0131klama yapt\u0131 ilgililer ama asl\u0131nda Rumlarla yeniden m\u00fczakere s\u00fcreci ba\u015flat\u0131lmas\u0131 s\u00f6z konusuydu ve <em>Rumlarla s\u00fcrt\u00fc\u015fme yaratacak \u00e7al\u0131\u015fmalar i\u00e7erisinde olmamak gerekti\u011fi<\/em>, d\u00fc\u015f\u00fcn\u00fcl\u00fcyordu. \u0130ktidarda olan Cumhuriyet\u00e7i T\u00fcrk Partisi ve Mehmet Ali Talat da Vak\u0131f Mallar\u0131n\u0131n al\u0131nabilece\u011fine inanm\u0131yordu.<\/p>\n<p>KKTC mahkemelerinin tan\u0131nmad\u0131\u011f\u0131n\u0131 iddia ettiler ama Mara\u015f\u2019la ilgili davalarda yetkili mahkeme zaten Magusa\u2019daki mahkemelerdi. \u0130kincisi TMK\u2019n\u0131n kararlar\u0131 A\u0130HM taraf\u0131ndan onaylan\u0131r ve emsal kabul edilir. \u00dc\u00e7\u00fcnc\u00fcs\u00fc Vak\u0131f Mallar\u0131na ili\u015fkin hukuki stat\u00fc (Ahkam\u00fcl evkaf) ile Kilise Topraklar\u0131na ili\u015fkin hukuki stat\u00fc birbiriyle \u00f6rt\u00fc\u015f\u00fcr. De\u011fi\u015fmeyen kural ise Vak\u0131flar devredilemez, ba\u011f\u0131\u015flanamaz ve sat\u0131lamazlar. Kilise topraklar\u0131 nas\u0131l ki g\u00f6r\u00fc\u015fmelere konu dahi edilmeden iade edilecek toprak kapsam\u0131nda g\u00f6r\u00fcl\u00fcyor, ayn\u0131s\u0131 T\u00fcrk Vak\u0131f Mallar\u0131 i\u00e7in de ge\u00e7erlidir. Vak\u0131f mallar\u0131 da Mara\u015f\u2019la s\u0131n\u0131rl\u0131 de\u011fildir.<\/p>\n<p>\u00d6te yandan Osmanl\u0131 d\u00f6nemine ait bir hukuktan bahsetmiyoruz. Vak\u0131f Mallar\u0131n\u0131n bu stat\u00fcs\u00fcn\u00fc \u0130ngiltere y\u00f6netimi devral\u0131rken tan\u0131m\u0131\u015ft\u0131 ve hukuki sistem 1960 Anla\u015fmalar\u0131 ile kurulan K\u0131br\u0131s Cumhuriyeti i\u00e7in de ba\u011flay\u0131c\u0131yd\u0131. Bu nedenle \u0130ngiliz Y\u00f6netimi gibi 1960-1963 d\u00f6neminde K\u0131br\u0131s Cumhuriyeti de Vak\u0131f m\u00fclklerinden toplad\u0131\u011f\u0131 kira bedellerini Vak\u0131f \u0130daresi\u2019ne \u00f6demekteydi. Bu, icareteynli vak\u0131flara ait zemin kiras\u0131 bedeli olarak belirlenmi\u015f 2230 Sterlinlik bedeldi. Kay\u0131tlara zemin kiras\u0131 olarak girmesi, arazilerin Vakfa aitli\u011finin tan\u0131nd\u0131\u011f\u0131, sadece arazi \u00fcst\u00fcne yap\u0131lan yap\u0131n\u0131n ki\u015fi \u00fczerine kaydedildi\u011fi anlam\u0131na geliyor. Hatta ilk d\u00f6nem kay\u0131tlar\u0131na g\u00f6re \u0130ngiltere 1878\u2019de y\u00f6netime geldi\u011finde Osmanl\u0131 Devleti\u2019ne \u00f6demesi icap eden kira bedeli 96 bin alt\u0131n iken \u2013ki hi\u00e7 \u00f6deme yapmad\u0131- Vak\u0131f m\u00fclklerinden toplad\u0131\u011f\u0131 kira 5 milyon alt\u0131n ediyordu. Sonu\u00e7ta Osmanl\u0131 aday\u0131 ge\u00e7ici olarak \u0130ngilizlere verdi\u011finde, Ada\u2019n\u0131n y\u00fczde 14\u2019\u00fc vak\u0131f mal\u0131 stat\u00fcs\u00fcndeydi. \u00d6nemli olan \u015fu: Sistem i\u015fliyordu. Usuls\u00fcz devir i\u015flemleri ise \u0130ngiltere\u2019nin 1944\u2019te \u00e7\u0131kard\u0131\u011f\u0131 bir kanunla baz\u0131 vak\u0131f m\u00fclklerini 10 y\u0131ldan fazlad\u0131r i\u015fletenlere devretmesidir. (Ama kira bedellerini, d\u00fc\u015f\u00fck tutarlarda olsa da Vak\u0131flar \u0130daresi\u2019ne \u00f6demeye devam etti.) Bu konudaki p\u00fcf noktalar\u0131ndan biri ise bu kanunun mazbut ve m\u00fclhak vak\u0131flar\u0131 kapsam d\u0131\u015f\u0131 b\u0131rakm\u0131\u015f olmas\u0131d\u0131r. Dolay\u0131s\u0131yla Mara\u015f\u2019taki Vak\u0131f Mallar\u0131n\u0131n devri usuls\u00fcz olmu\u015ftur. Vak\u0131f mallar\u0131n\u0131n devredilemez, takas edilemez, sat\u0131lamaz, ba\u011f\u0131\u015flanamaz stat\u00fcs\u00fc de bu t\u00fcr i\u015flemleri yok h\u00fckm\u00fcnde k\u0131lar.<\/p>\n<p>Vak\u0131f \u0130daresi, bir komisyon kurarak 1571\u2019den 1974\u2019e kadar b\u00fct\u00fcn Vak\u0131f Mallar\u0131n\u0131 inceledi. 2 bin 443 k\u00fct\u00fck defteri, 13 bin dosya ve 8 milyon belge incelendi, 20 Milyon veri \u00e7\u0131kart\u0131ld\u0131 ve hepsi de bilgisayar ortam\u0131na ge\u00e7irildi. K\u0131br\u0131s\u2019taki herhangi bir parselin hangi i\u015flemlerden ge\u00e7ti\u011fini g\u00f6rebilecek ve ispatlayabilecek bir sistem kurdular.<a href=\"#_ftn10\" name=\"_ftnref10\">[10]<\/a> K\u0131sacas\u0131 Vak\u0131flar \u0130daresi, K\u0131br\u0131s T\u00fcrk halk\u0131n\u0131n yarar\u0131na b\u0131rak\u0131lm\u0131\u015f, birer kamu ekonomi kayna\u011f\u0131 olan m\u00fclkleriyle ilgili bu dosyaya \u00e7ok iyi haz\u0131rland\u0131. Mara\u015f\u2019\u0131n a\u00e7\u0131lmas\u0131 ise Vak\u0131flar \u0130daresi\u2019nin buradaki m\u00fclkleri i\u00e7in a\u00e7aca\u011f\u0131 davalar\u0131n sonucu ne olursa olsun konunun politik arenaya ta\u015f\u0131nmas\u0131 bak\u0131m\u0131ndan \u00e7ok \u00f6nemli bir ad\u0131m. Yeni bir s\u00fcrece i\u015faret ediyor.<\/p>\n<h2><strong>Sonu\u00e7: \u0130ki devletli \u00e7\u00f6z\u00fcm<\/strong><\/h2>\n<p>Kapal\u0131 tutulan Mara\u015f\u2019\u0131n KKTC idaresi alt\u0131nda, eski sakinlerine yap\u0131lacak bir \u00e7a\u011fr\u0131yla a\u00e7\u0131lmas\u0131 ve ya\u015fayan bir kente d\u00f6nd\u00fcr\u00fclmesi projesi, bug\u00fcn yeni bir m\u00fczakere s\u00fcrecini tetikleyen ve ayn\u0131 zamanda ba\u015flamas\u0131n\u0131 da engelleyen bir geli\u015fme oldu. Rum Y\u00f6netimi, Mara\u015f\u2019\u0131n a\u00e7\u0131lmas\u0131 durumunda burada m\u00fclk\u00fc bulunan 3. \u00fclke vatanda\u015flar\u0131n\u0131n ve hatta art\u0131k m\u00fclklerine geri d\u00f6nme umutlar\u0131n\u0131 yitiren Rumlar\u0131n bu \u00e7a\u011fr\u0131ya cevap verece\u011finin fark\u0131nda. Hele ki s\u00f6z konusu olan art\u0131k m\u00fclk\u00fcn miras\u00e7\u0131s\u0131ysa Rum Y\u00f6netiminin alaca\u011f\u0131 \u00f6nlemler yetersiz kalacakt\u0131r. Daha \u00f6nce TMK\u2019ya ba\u015fvuranlar\u0131 vatan haini ilan etmesi m\u00fclklerini almak isteyen Rumlar\u0131 engellememi\u015fti. 10 ki\u015finin dahi m\u00fclk\u00fc i\u00e7in KKTC\u2019ye ba\u015fvurmas\u0131 K\u0131br\u0131s meselesinde geri d\u00f6n\u00fc\u015f\u00fc olmayan yeni bir d\u00f6neme resmiyet kazand\u0131racakt\u0131r. \u00dcstelik bu \u00e7\u00f6z\u00fcmde A\u0130HM damgas\u0131 olacakt\u0131r. KKTC, K\u0131br\u0131s\u2019ta nas\u0131l bir \u00e7\u00f6z\u00fcm modeli istedi\u011fi konusunda Rum taraf\u0131na \u00f6ncelik tan\u0131yan yakla\u015f\u0131ma itiraz ediyor ve Mara\u015f bunun i\u00e7in iyi bir ad\u0131m.<\/p>\n<p>Mara\u015f\u2019\u0131n a\u00e7\u0131lmas\u0131, art\u0131k iplerin at\u0131ld\u0131\u011f\u0131n\u0131 sembolize ediyor. Mara\u015f, art\u0131k pazarl\u0131k kozu de\u011fil,\u00a0 direk u\u00e7u\u015flar\u0131n ba\u015flamas\u0131 ile ili\u015fkilendirilmiyor, kar\u015f\u0131l\u0131\u011f\u0131nda bir taviz al\u0131nmas\u0131 planlanm\u0131yor. Aksine a\u00e7\u0131k ki uluslararas\u0131 hukukta sonu\u00e7lar do\u011furacak bir devlet tasarrufuna gidiliyor; KKTC\u2019nin ba\u011f\u0131ms\u0131zl\u0131\u011f\u0131n\u0131 ilan etmi\u015f bir devlet oldu\u011funun alt\u0131 \u00e7iziliyor. Uluslararas\u0131 hukuka, konjonkt\u00fcre uygun \u015fekilde eski sakinleri davet ediliyor. Mara\u015f\u2019\u0131n a\u00e7\u0131lmas\u0131, kal\u0131c\u0131 b\u00f6l\u00fcnmenin ilan edilmesidir. Federasyon hedefli bir \u00e7\u00f6z\u00fcme ula\u015f\u0131lmas\u0131 GKRY\u2019nin yakla\u015f\u0131m\u0131 nedeniyle imk\u00e2ns\u0131z g\u00f6r\u00fcl\u00fcyor ve 1959-1960 kurulu\u015f anla\u015fmalar\u0131n\u0131 yok sayan \u00f6neriler de kabul edilemez addediliyor. K\u0131br\u0131s T\u00fcrk\u00fc, Rumlar\u0131n ortak idareyi reddetmesi kar\u015f\u0131s\u0131nda Ada\u2019n\u0131n b\u00fct\u00fcn\u00fcndeki y\u00f6netim hakk\u0131ndan vazge\u00e7iyor ama kendine kalan b\u00f6lgedeki egemenlik haklar\u0131nda da \u0131srar ediyor. \u00dc\u00e7\u00fcnc\u00fc \u00fclkelerden de Rumlar\u0131n uzla\u015fmaz tavr\u0131 nedeniyle almak zorunda kald\u0131\u011f\u0131 bu karar\u0131 kabul etmeye ve tan\u0131maya davet ediyor.
