T\u00fcrkiye, Do\u011fu Akdeniz\u2019deki haklar\u0131n\u0131 sondaj faaliyetleri ve diplomatik ad\u0131mlarla koruma kararl\u0131l\u0131\u011f\u0131 g\u00f6sterirken K\u0131br\u0131s meselesi de kulvar de\u011fi\u015ftirdi. \u00a0Bir Rum liderin ilk kez iki devletli \u00e7\u00f6z\u00fcmden bahsetmesi, K\u0131br\u0131s meselesi i\u00e7in yeni bir d\u00f6nemin i\u015fareti oldu. KKTC\u2019nin Annan Plan\u0131\u2019ndan bu yana bekledi\u011fi tan\u0131nma ve iki devletli \u00e7\u00f6z\u00fcm aray\u0131\u015f\u0131, K\u0131br\u0131s\u2019a kal\u0131c\u0131, s\u00fcrd\u00fcr\u00fclebilir ve adil bir bar\u0131\u015f\u0131 getirebilir.<\/p>\n<p>K\u0131br\u0131s\u2019ta federasyon hedefli \u00e7\u00f6z\u00fcm aray\u0131\u015flar\u0131 i\u00e7in Annan Plan\u0131 referandumu asl\u0131nda son noktayd\u0131. Bu muameleyi g\u00f6rmeliydi. \u00c7\u00fcnk\u00fc m\u00fczakereler, ortaya \u00e7\u0131kan plan\u0131n halk\u0131n onay\u0131na sunulmas\u0131 ile sonu\u00e7lan\u0131r. \u00dcstelik plan\u0131n e\u015f zamanl\u0131 ama iki taraf i\u00e7in ayr\u0131 ayr\u0131 kurulan sand\u0131klarda referanduma sunulmas\u0131, BM\u2019nin a\u00e7\u0131k\u00e7a K\u0131br\u0131sl\u0131 T\u00fcrklerin kendi kaderini tayin hakk\u0131n\u0131 tan\u0131d\u0131\u011f\u0131n\u0131 g\u00f6sterir. T\u00fcrklerin bu hakk\u0131n\u0131n Rumlar\u0131n iradesinden ba\u011f\u0131ms\u0131z g\u00f6r\u00fcld\u00fc\u011f\u00fcn\u00fcn ve dolay\u0131s\u0131yla K\u0131br\u0131sl\u0131 T\u00fcrklerin kendi kaderini tayin edebilecek bir \u201chalk\u201d olarak tan\u0131nd\u0131\u011f\u0131n\u0131n if\u015fas\u0131d\u0131r. Esasen K\u0131br\u0131s\u2019taki T\u00fcrklerin Rumlar\u0131nkine paralel \u201cEgemen E\u015fitli\u011fi\u201d ve self- determinasyon hakk\u0131, -evveliyat\u0131 olmakla birlikte- 19 Aral\u0131k 1956\u2019da \u0130ngiltere D\u0131\u015fi\u015fleri Bakan\u0131 Sir Alan Lennox Boyd taraf\u0131ndan Enosis\u2019e kar\u015f\u0131, \u0130ngiliz Parlamentosunda zab\u0131tlara tescil ettirilmi\u015fti. Yunanistan\u2019\u0131n 1950\u2019den itibaren BM Genel Kurulu\u2019ndan T\u00fcrklerin az\u0131nl\u0131k say\u0131laca\u011f\u0131 bir karar \u00e7\u0131karmak i\u00e7in verdi\u011fi u\u011fra\u015f\u0131lar bo\u015fa \u00e7\u0131km\u0131\u015ft\u0131; iki giri\u015fimi de Genel Kurul\u2019da reddedilmi\u015fti. 1959-1960 Anla\u015fmalar\u0131 da T\u00fcrklerin egemen e\u015fitli\u011fi \u00e7er\u00e7evesine uygun \u015fekillendirilmi\u015f; K\u0131br\u0131s Cumhuriyeti bu esasla kurulmu\u015f ve tan\u0131nm\u0131\u015ft\u0131.<\/p>\n<p>Rumlar\u0131n, K\u0131br\u0131s Cumhuriyeti\u2019nin resmi h\u00fck\u00fcmeti olmas\u0131 ise BM Bar\u0131\u015f G\u00fcc\u00fc\u2019n\u00fc resmi bir h\u00fck\u00fcmetin davet etmesi gerekti\u011fi gerek\u00e7esi ve \u201cge\u00e7ici\u201d bir durum oldu\u011fu s\u00f6z\u00fcyle T\u00fcrkiye\u2019nin ikna edilmesi \u00fczerine ger\u00e7ekle\u015fti; \u00a0BM G\u00fcvenlik Konseyi, 4 Mart 1964\u2019te 186 say\u0131l\u0131 karar\u0131yla Ada\u2019da Bar\u0131\u015f G\u00fcc\u00fc\u2019n\u00fc olu\u015fturdu. 13 May\u0131s 1983\u2019te Rumlar\u0131n yeni bir denemesiyle BM Genel Kurulu\u2019ndan K\u0131br\u0131s\u2019ta tek bir halk oldu\u011funu ifade etmekle T\u00fcrk halk\u0131n\u0131 \u201caz\u0131nl\u0131k\u201d olarak g\u00f6rm\u00fc\u015f olan 37\/253 say\u0131l\u0131 karar \u00e7\u0131kar\u0131ld\u0131. K\u0131br\u0131s T\u00fcrk Halk\u0131n\u0131n buna yan\u0131t\u0131 15 Kas\u0131m 1983\u2019te self-determinasyon hakk\u0131na dayanarak KKTC&#8217;yi ilan etmek oldu.<\/p>\n<p>Annan Plan\u0131 referandumu, BM\u2019nin K\u0131br\u0131sl\u0131 T\u00fcrklerin self determinasyon hakk\u0131n\u0131 kabul etme \u2013ve Rumlara da kabul ettirmi\u015f oldu- noktas\u0131na geri d\u00f6n\u00fc\u015f\u00fcd\u00fcr. Dahas\u0131, plan\u0131n KKTC\u2019nin daha \u00f6nce yapt\u0131\u011f\u0131 uluslararas\u0131 anla\u015fmalar\u0131n yeni devleti ba\u011flayaca\u011f\u0131n\u0131 ifade eden 12. maddesi de KKTC\u2019nin \u201cdevlet\u201d niteli\u011fine yap\u0131lan vurgudur. Annan Plan\u0131, T\u00fcrklere verilen \u201cEvet, deyin Rumlar hay\u0131r derse KKTC tan\u0131nacak\u201d s\u00f6z\u00fcn\u00fcn yerine getirilmesi i\u00e7in m\u00fckemmel bir zemin sunuyordu. Ama i\u015fte Do\u011fu Akdeniz\u2019deki hidrokarbon rezervleri meselesi de bu noktada K\u0131br\u0131s sorununa etki etti ve muazzam b\u00fcy\u00fckl\u00fckte rezervlerden bahsedilip bunun T\u00fcrkiye \u00fczerinden Avrupa\u2019ya ula\u015ft\u0131r\u0131lmas\u0131na ili\u015fkin \u0130srail projesi ortaya at\u0131ld\u0131. K\u0131br\u0131s i\u00e7in yeniden federasyon temelli m\u00fczakere s\u00f6z konusu oldu.<\/p>\n<h2><strong>Son federasyon denemeleri<\/strong><\/h2>\n<p>Federasyon hedefine en \u00e7ok inanan iki isim olan Mehmet Ali Talat (2005-2010) ve Hristofyas (2008-2013) d\u00f6neminde, 2008\u2019de<a href=\"#_ftn1\" name=\"_ftnref1\">[1]<\/a> yeniden ba\u015flat\u0131lan m\u00fczakereler, belki en \u00e7ok Talat i\u00e7in hayal k\u0131r\u0131kl\u0131\u011f\u0131 oldu. \u00c7\u00fcnk\u00fc AKEL<a href=\"#_ftn2\" name=\"_ftnref2\">[2]<\/a> lideri Hristofyas, iktidara gelince Makarios g\u00f6mle\u011fini giymi\u015fti; Rum Ulusal Konseyi\u2019nin belirledi\u011fi \u00e7izgilerin d\u0131\u015f\u0131nda \u00e7\u0131kamam\u0131\u015f, \u00e7\u0131kmak da istememi\u015fti. <em>Makarios bak\u0131\u015f a\u00e7\u0131s\u0131<\/em>, K\u0131br\u0131sl\u0131 T\u00fcrkleri az\u0131nl\u0131k g\u00f6ren ve devlet y\u00f6netiminde say\u0131s\u0131 (n\u00fcfusu) kadar s\u00f6z sahibi olmas\u0131 gerekti\u011fi yakla\u015f\u0131m\u0131n\u0131 ifade eder. Y\u0131llar da ge\u00e7se, liderler de de\u011fi\u015fse bu bak\u0131\u015f a\u00e7\u0131s\u0131 de\u011fi\u015fmedi. Talat, federasyonun gere\u011fi olan y\u00f6netimde e\u015fit s\u00f6z sahibi olma yakla\u015f\u0131m\u0131n\u0131, Hristofyas gibi politik olarak ayn\u0131 do\u011frulara inand\u0131\u011f\u0131 bir isme dahi kabul ettirememi\u015fti.<\/p>\n<p>Asl\u0131nda iki devletli \u00e7\u00f6z\u00fcme gidi\u015f, Talat\u2019\u0131n liderli\u011fi d\u00f6neminde ba\u015flat\u0131lmal\u0131yd\u0131. \u00c7\u00fcnk\u00fc Hristofyas, 2010\u2019da KKTC\u2019de Cumhurba\u015fkanl\u0131\u011f\u0131 se\u00e7imlerine gidilirken Talat\u2019\u0131n mutabakata var\u0131lan konularla ilgili ortak a\u00e7\u0131klama yapma teklifini bile reddetmi\u015fti. Sonras\u0131nda da Talat\u2019tan ald\u0131\u011f\u0131 tavizleri cebine koyarak kendi verdiklerini reddetmi\u015f ve KKTC\u2019nin yeni Cumhurba\u015fkan\u0131 Dervi\u015f Ero\u011flu (2010-2015) ile bunlar\u0131 yeniden m\u00fczakereye a\u00e7m\u0131\u015ft\u0131. Nikos Anastasiadis\u2019in (2013-2018+) Rum taraf\u0131nda Cumhurba\u015fkan\u0131 se\u00e7ilmesinden sonra m\u00fczakere s\u00fcreci yeni bir noktaya ta\u015f\u0131nd\u0131 ve 11 \u015eubat 2014 tarihli Liderlerin Ortak A\u00e7\u0131klamas\u0131 ile m\u00fczakereler yeniden ba\u015flad\u0131. Mustafa Ak\u0131nc\u0131\u2019n\u0131n (2015-2019) g\u00f6reve ba\u015flamas\u0131yla ise m\u00fczakereler art\u0131k New York\u2019a, Cenevre\u2019ye ta\u015f\u0131nabilecek denli ilerlemi\u015f g\u00f6r\u00fcn\u00fcyordu.<\/p>\n<p>Ak\u0131nc\u0131, kendi h\u00fck\u00fcmetinden gizli bir harita \u00f6nerisi bile verdi ama Crans Montana\u2019da 7 Temmuz 2017\u2019de BM Genel Sekreteri\u2019nce s\u00fcrecin \u00e7\u00f6kt\u00fc\u011f\u00fc resmi olarak a\u00e7\u0131kland\u0131\u011f\u0131nda, yakla\u015f\u0131k 10 y\u0131l s\u00fcren yeni uzla\u015f\u0131 aray\u0131\u015flar\u0131nda hen\u00fcz Y\u00f6netim ve G\u00fc\u00e7 Payla\u015f\u0131m\u0131 Ba\u015fl\u0131\u011f\u0131 alt\u0131nda dahi tam mutabakata var\u0131lamam\u0131\u015f bir dizi a\u00e7\u0131k oldu\u011fu anla\u015f\u0131ld\u0131. \u00c7\u00fcnk\u00fc temel sorun 1963\u2019ten bu yana ayn\u0131yd\u0131: <em>Rumlar T\u00fcrklerle egemenli\u011fi payla\u015fmak istemiyordu<\/em>. Egemenli\u011fin payla\u015f\u0131lmas\u0131 ise <em>siyasi e\u015fitli\u011fin kabul\u00fcn\u00fc<\/em> gerektirir. Siyasi e\u015fitli\u011fin iki temel g\u00f6stergesi bulunur: D\u00f6n\u00fc\u015f\u00fcml\u00fc ba\u015fkanl\u0131k (veto hakk\u0131 korunarak) ve karar alma s\u00fcre\u00e7lerine etkin kat\u0131l\u0131m. Karar alma s\u00fcre\u00e7lerine etkin kat\u0131l\u0131m ise parlamentoda T\u00fcrk vekillerin ve bakanlar kurulunda T\u00fcrk bakanlar\u0131n oylar\u0131n\u0131n <em>\u00f6zel bir \u00e7o\u011funluk say\u0131s\u0131yla<\/em> belirlenmesidir. Bu, T\u00fcrk vekillerin oylar\u0131n\u0131n \u00e7o\u011funluk Rum oylar\u0131 ile etkisiz k\u0131l\u0131nmas\u0131n\u0131 engelleyecek bir \u00f6nlemdir. Bahsetti\u011fimiz hukuki sistemin kayna\u011f\u0131 ise 1960 Anayasas\u0131 ve K\u0131br\u0131s Cumhuriyeti\u2019ni kuran 1959, 1960 Londra ve Z\u00fcrih Anla\u015fmalar\u0131d\u0131r. K\u0131br\u0131s Cumhuriyeti, iki uluslararas\u0131 anla\u015fmayla <em>sui generis yap\u0131da, ba\u011f\u0131ms\u0131zl\u0131\u011f\u0131 ve egemenli\u011fi s\u0131n\u0131rl\u0131 bir devlet <\/em>olarak kurulmu\u015ftur. Asl\u0131nda bu husus, K\u0131br\u0131sl\u0131 T\u00fcrklerin iki devletli \u00e7\u00f6z\u00fcm istencinin en \u00f6nemli hukuki zeminini te\u015fkil eder. \u00c7\u00fcnk\u00fc ya bu \u015fartlarla yeniden bir devlet \u00e7at\u0131s\u0131 alt\u0131na girilir ya da K\u0131br\u0131sl\u0131 T\u00fcrkler kendi kaderlerini tayin haklar\u0131n\u0131 kullan\u0131rlar.<\/p>\n<h2><strong>Federasyon ihtimalinin t\u00fcketilmesi<\/strong><\/h2>\n<p>T\u00fcrkiye, Temmuz 2017\u2019de son Cenevre Zirvesi de \u00e7\u00f6kt\u00fc\u011f\u00fcnde<a href=\"#_ftn3\" name=\"_ftnref3\">[3]<\/a> masadan kalkarken BM parametrelerinde \u0131srar etmenin anlam\u0131n\u0131n kalmad\u0131\u011f\u0131n\u0131 a\u00e7\u0131klad\u0131. Anastasiadis de T\u00fcrkiye D\u0131\u015fi\u015fleri Bakan\u0131 Mevl\u00fct \u00c7avu\u015fo\u011flu\u2019na \u201cYetkiyi payla\u015fmaya Rum toplumunun haz\u0131r olmad\u0131\u011f\u0131 ve <em>art\u0131k iki devletli bir \u00e7\u00f6z\u00fcm\u00fcn g\u00fcndeme gelmesi<\/em> gerekti\u011fini\u201d s\u00f6yledi. A\u00e7\u0131klama Ak\u0131nc\u0131 taraf\u0131ndan da teyit edildi.<a href=\"#_ftn4\" name=\"_ftnref4\">[4]<\/a> Annan Plan\u0131\u2019ndan sonra ikinci kere KKTC\u2019nin \u00f6n\u00fcn\u00fc a\u00e7an yeni bir durum s\u00f6z konusuydu ama KKTC i\u00e7inde federasyoncular ve iki devletli \u00e7\u00f6z\u00fcm isteyenler ayr\u0131\u015fmas\u0131 kendini g\u00f6sterdi.<\/p>\n<p>KKTC y\u00f6netimindeki b\u00f6l\u00fcnme UBP-HP koalisyonu kurulunca belirginle\u015fti. Hem KKTC Ba\u015fbakan\u0131 Ersin Tatar hem KKTC D\u0131\u015fi\u015fleri Bakan\u0131 Kudret \u00d6zersay, federasyon g\u00f6r\u00fc\u015f\u00fclmesine kar\u015f\u0131 olduklar\u0131n\u0131 a\u00e7\u0131klad\u0131lar. KKTC meclisindeki toplam 50 milletvekilinin 35\u2019i, yani se\u00e7imlerde ald\u0131klar\u0131 oy oran\u0131 nedeniyle halk\u0131n y\u00fczde 70\u2019ini temsil eder say\u0131da parlamenter, federasyon g\u00f6r\u00fc\u015fme d\u00f6neminin bitti\u011fini; masaya ancak iki devletli form\u00fcl\u00fcn getirilebilece\u011fi g\u00f6r\u00fc\u015f\u00fcn\u00fc payla\u015f\u0131yordu. Ak\u0131nc\u0131 ve CTP ise federasyon \u00e7izgisinin korunmas\u0131 ve yeniden, hatta sonu\u00e7 alana dek federasyonun denenmesi taraftar\u0131 tav\u0131r ald\u0131lar.<\/p>\n<p>KKTC H\u00fck\u00fcmeti tam bu a\u015famada, 18 Haziran 2019\u2019da, 45 y\u0131ld\u0131r kapal\u0131 olan Mara\u015f\u2019\u0131n 1974 \u00f6ncesi sakinlerine KKTC y\u00f6netiminde a\u00e7\u0131lmas\u0131 i\u00e7in \u00e7al\u0131\u015fma ba\u015flatt\u0131.<a href=\"#_ftn5\" name=\"_ftnref5\">[5]<\/a> Karar, h\u00fck\u00fcmetin art\u0131k iplerin at\u0131ld\u0131\u011f\u0131n\u0131 sembolize eden bir ad\u0131m\u0131yd\u0131. <em>Mara\u015f\u2019\u0131n a\u00e7\u0131lmas\u0131, kal\u0131c\u0131 b\u00f6l\u00fcnmenin ilan edilmesidir.<\/em> A\u00e7\u0131k ki uluslararas\u0131 hukukta sonu\u00e7lar do\u011furacak bir <em>devlet tasarrufuna<\/em> gidiliyor; KKTC\u2019nin ba\u011f\u0131ms\u0131zl\u0131\u011f\u0131n\u0131 ilan etmi\u015f bir devlet oldu\u011funun alt\u0131 \u00e7iziliyordu. Karar, A\u0130HM\u2019e gitmek i\u00e7in bekleyen Mara\u015f\u2019la ilgili 274 davan\u0131n \u00e7\u00f6z\u00fcm\u00fc i\u00e7in de bir yol a\u00e7maktayd\u0131. Bu anlamda karar\u0131n zeminini yine uluslararas\u0131 hukuk olu\u015fturmaktad\u0131r.<\/p>\n<p>Mara\u015f\u2019\u0131n a\u00e7\u0131lmas\u0131 haz\u0131rl\u0131klar\u0131 ve T\u00fcrkiye\u2019nin Akdeniz\u2019deki sondajlar\u0131, Anastasiadis \u00fczerindeki \u201cT\u00fcrkleri masaya \u00e7ekmelisin\u201d bask\u0131s\u0131n\u0131 artt\u0131rd\u0131. Bask\u0131, \u201chay\u0131r\u201dc\u0131 AKEL\u2019den geliyor g\u00f6r\u00fcn\u00fcyordu. Ak\u0131nc\u0131\u2019n\u0131n Guterres \u00f6nerileri \u00e7izgisindeki yeni m\u00fczakere giri\u015fimine cevap veren Anastasiadis, T\u00fcrklerin kendi b\u00f6lgelerindeki y\u00f6netim yetkilerinin artaca\u011f\u0131 ama merkezi devletteki s\u00f6z hakk\u0131n\u0131n n\u00fcfusu oran\u0131nda olaca\u011f\u0131\/azalaca\u011f\u0131 bir m\u00fczakere zemini \u00f6nerdi. Bu, T\u00fcrklerin 1960 K\u0131br\u0131s Cumhuriyeti Anayasas\u0131\u2019ndaki t\u00fcm haklar\u0131n\u0131n muhtariyet \u00e7er\u00e7evesine indirilmesi anlam\u0131na gelir. Ak\u0131nc\u0131, \u2018gev\u015fek federasyon\u2019 dedi; Anastasiadis desantralizasyon dedi. Liderlerin bahsettikleri \u00e7\u00f6z\u00fcm planlar\u0131 birbirine z\u0131tt\u0131 ama yine de BM Genel Sekreteri\u2019nin K\u0131br\u0131s \u00d6zel Temsilcisi Jane Holl Lute, referans belgesi haz\u0131rlamak \u00fczere Ada\u2019ya davet edildi. Anastasiadis, Ak\u0131nc\u0131\u2019n\u0131n \u015fart ko\u015ftu\u011fu siyasi e\u015fitlik, etkin kat\u0131l\u0131m ve takvimin belgede yer almas\u0131n reddetti; garant\u00f6rl\u00fc\u011f\u00fcn ve sondaj faaliyetlerinin sonland\u0131r\u0131lmas\u0131 \u015fart\u0131n\u0131 \u00f6ne s\u00fcrd\u00fc. G\u00f6r\u00fc\u015fmeleri ba\u015flatabilecek kadar dahi uzla\u015f\u0131 sa\u011flanamad\u0131.<\/p>\n<p>Sonu\u00e7 itibariyle Annan Plan\u0131\u2019ndan sonra ba\u015flat\u0131lan 2008 m\u00fczakere s\u00fcreci, 2017\u2019de federasyonun do\u011fru bir hedef olmad\u0131\u011f\u0131 mutabakat\u0131 ile kesin olarak sonu\u00e7land\u0131r\u0131lm\u0131\u015f; 2018\u2019de Ak\u0131nc\u0131\u2019n\u0131n yeni bir deneme giri\u015fimi Eyl\u00fcl 2019\u2019da t\u00fcketilmi\u015f ama kesin uzla\u015fmazl\u0131\u011fa \u00a0ra\u011fmen dosya BM nezdinde a\u00e7\u0131k b\u0131rak\u0131lm\u0131\u015ft\u0131r.<\/p>\n<h2><strong>Kadife ayr\u0131l\u0131k veya s\u00fcr\u00fcnceme <\/strong><\/h2>\n<p>K\u0131br\u0131s\u2019ta sorun b\u00f6l\u00fcnm\u00fc\u015fl\u00fck m\u00fc yoksa b\u00f6l\u00fc\u015fememek mi? Bu soru, K\u0131br\u0131s sorununun \u00f6z\u00fcn\u00fc ifade eder. Y\u0131llard\u0131r m\u00fczakere masas\u0131nda yo\u011frulan fikir ve \u00f6nerilerin iki devletli form\u00fcl\u00fcn \u015fekillendirilmesine y\u00f6nlendirilmesi i\u00e7in gereken t\u00fcm ko\u015fullar mevcut. Yine bir masada ama bu kez s\u0131n\u0131rlar\u0131n belirlenmesi, iade edilecek topraklar\u0131n g\u00f6r\u00fc\u015f\u00fclmesi, tazminatlar\u0131n belirlenmesi, hidrokarbon zenginli\u011finin payla\u015f\u0131m\u0131 gerekiyor. Bug\u00fcn KKTC, tam ba\u011f\u0131ms\u0131z olarak kurulmu\u015f ve ilan edilmi\u015f bir devlet olarak en g\u00fc\u00e7l\u00fc pazarl\u0131\u011f\u0131n\u0131 yapabilecek konumdad\u0131r. Ada\u2019daki varl\u0131\u011f\u0131n\u0131 GKRY ile yan yana ve devletler hukukunun birer e\u015fit s\u00fcjesi olarak idame ettirme azmindedir.
